I was told by my lawyer that unless they amputate the wrong limb or remove the wrong organ, fail to diagnose an obvious cancer, or drop a baby or delay a section then they won't even take the case. You have to prove lost wages and major physical harm/ disability or death. For example, there was a case of a man with seizures who needed to be confined to his bed with restraints. It was in his orders. The hospital neglected to do that. The man had a violent seizure, fell to the ground and died. He was 87. They determined his life was not worth suing over b/c the monetarily value of life at 87 is nil. No lost wages, not much time left anyway. The lawyers wouldn't even take it. People sue over civil cases like spilling hot coffee and win millions but it is nearly impossible to win a medical malpractice case. The docs could be as rude as can be and nothing can be done about it. I even wanted to file a medical complaint in my state against a doctor who did much worse than that - he kicked me out of his office when I was unable to walk and told me that he never wanted to see my kind again b/c my husband sexually abused me. ( My husband is the man of my dreams and at the time my v was swollen, purple and had stitches from a biopsy. I am a good person and even if I wasn't no one should ever be treated that way.) The state said that rudeness doesn't even qualify as a complaint!!! The AMA wants you to think that medical malpractice suits are rampant. It isn't. It is the lawyers and insurance brokers that get most of the profits anyway. Very litle goes to people actually harmed. If these docs practiced safer medicine, no 36 hour shifts, more required continuing education, longer visits with patients, computerized checks of medication and records in hospitals, then there wouldn't be so many proplr harmed. I personally think drs need to practice safer medicine by modifying protocols, and profits of insurance brokers and companies need to be examined. Anyway that is my speech on medical malpractice from someone who had a real legitamite case that couldn't sue. Actually my suit wasn't even over the rudeness of that dr but actual malpractice where a doc didn't recognize an infection or even culture, ignored my complaints of a chemical burn, and burnt me with Temovate by applying it on globs when only a small amount should ever be applied to the vulva. Actual malpractice and I didn't have a case. SO certainly testing nerve threshhold with a pin ( which I have had done too) would never even qualify. It is ashame it is so difficult to get these docs to behave. It is ashame they won't reform from within even though medical errors are a huge cause of mortality and morbidity in this country. It is ashame we are virtually powserless and they pretend that the docs and insurance companies are being abused by moneyhungry patients. It is just not so!!! Off my soap box now! I hope you tell your story to the Wood Foundation. They are trying to help get things changed as far as healthcare in this country. There was a series on ABC News 2 weeks ago on the Prescription for Health care change in America and then the PBS 4 parts series of Remaking American Medicine. I'm hoping that the episodes are on the PBS site so that I can watch those episodes again, in particular the very first episode where they talked a lot about medical errors.
