Dear Roy,

This matter I am bringing to your attention may seem off topic to some on

your list. However, I think it is highly related. We are at high risk of

losing more of our civil and constitutional rights in this country and this

bill represents a trend which deeply concerns me. It would shift the role

of our public officials and the medical community into enforcement and away

from care giving and patient confidentiality. I think more public

accountability and a balance of power in calling for a " State of Emergency "

in concert with the State Legislature is needed at a minimum!

Here is a link to the full text of a bill now under consideration by the

California State Legislature called the Emergency Health Powers Act, AB

1763, introduced by California State Assemblyman Richman (R-Granada Hills).

The bill was introduced in January in response to a model bill initiated by

U.S Secretary of Health and Human Services Tommy . For states who

adopt comparable legislation, they will be eligible for federal

funding. The bill contains the following provisions to:

>Give the Governor authority to declare a state of public health emergency

>without consulting anyone and without any accountability, not even to the

>Legislature. It gives power to the State or an unelected Public Health

>Director to-

>Requires any individual to be vaccinated (contrary to the Nuremberg

>Code.) Refusal constitutes a crime and will result in quarantine.

>Quarantine or isolation may be imposed without prior informed consent;

>without consideration of personal beliefs, prior medical conditions or

>contraindications; and without any provision to keep families together,

>including keeping children with their parents or legal guardians during

>quarantine or isolation.

>

>Require any individual to undergo specific medical treatment. Refusal

>constitutes a crime and will result in quarantine.

>

>Seize any property, including real estate, food, medicine, fuel or

>clothing, an official thinks necessary to handle the emergency.

>

>Seize and destroy any property alleged to be hazardous. There will be no

>compensation or recourse.

>

>Draft you or your business into state service.

>

>Impose rationing, price controls, quotas and transportation controls.

>

>Suspend any state law, regulation or rule that is thought to interfere

>with handling the declared emergency.

>It also requires pharmacists to report data on over-the-counter sales, and

>customer information that pharmacists are not required to obtain under

>current law (proposed Section 130380, 130382, & 130384).

We are strongly opposed to AB 1763 for many reasons, including the following:

AB effectively 1763 forces physicians, dentists, nurses, paramedics, lab

technicians, pharmacists, and other professionals as well as public or

private, for-profit or non-profit medical facilities into involuntary

servitude during a declared state of public health emergency under threat

of losing their license to practice in California (proposed Health and

Safety Code Sections 130442 and 130520).

AB 1763 violates patient privacy by requiring physicians, pharmacists,

dentists and others to report personally identifying information about

patients before there is a declaration of a state of public emergency, and

without the patient's written consent. It also requires pharmacists to

report data on over-the-counter sales, and customer information that

pharmacists are not required to obtain under current law (proposed Section

130380, 130382, & 130384).

AB 1763, contrary to the Nuremberg Code, calls for mandatory immunizations

(or quarantine or isolation) without prior informed consent; without

consideration of personal beliefs, prior medical conditions or

contraindications; and without any provision to keep families together,

including keeping children with their parents or legal guardians during

quarantine or isolation.

AB 1763 gives the Governor inappropriate authority to declare a state of

public health emergency without consulting anyone and without any

accountability, not even to the Legislature, for 30 days.

AB 1763 inappropriately gives police powers over medical professionals,

medical facilities, and ordinary citizens to the Department of Health

Services, to local government agencies responsible for protecting the

public's health, and to any person designated by them.

AB 1763 ignores the California Emergency Services Act and all other

existing laws, including provisions in the Health and Safety Code, which

are in place and have been proven effective to address potential and actual

emergencies that could affect public health.
