Hey folks,

Many of you may remember when I was hurt last year while working on

an ambulance in County. The guy that assaulted me,

Lawson Cotton, received 7 years in TDC, but is eligible for parole in

less than 6 months (for a grand total of 18 months in jail). Here is

where I need your help...I need as many protest letters as possible

sent by as many people as possible to show that we will not allow

offenders to simply " get away " with injurying folks while on duty.

He needs to stay put for a while as he was just transferred from

County to TDC less than a week ago.

Ladies and Gentlemen-

This is an opportunity for us to truly stand together and speak with one

voice. We as medics are confronted daily with what happened to Donnie and the

results could be the same. Donnie was very fortunate that he survived; the next

time the medic might not be as lucky.

Help to prevent a next time. This was a medic injured in the line of duty and

no other public safety group would stand still for this 'justice' If this

convicted felon is allowed to leave prison after 18 months, that only says to

the world how we are valued.

Prove to the world we are worth more and prove to the world we can be united.

It doesn't matter who signs your check, the color of your shirt or the color of

your patch, this effects all of us and we must stand to gether, for our

protection and dignity. Nurses would not stand for this; they would be in front

of the TDCJ with signs were this to happen to a nurse.

I didn't realize that the DAs office could protest. I have an

excellent relationship with several of the attorneys at the DAs

office and will ask them for their help. I am sure that they will be

willing to help.

Thanks for all of your help...there isn't any legitimate reason why

this guy should be paroled. He has only been in the TDCJ system for

a week, and will be up for parole review by August. An impression

needs to be made to the parole board so that they do not let him slip

through the cracks.

I apologize in asking - what exactly did this guy do? Obviously, there was an

assault charge for attacking a paramedic. But just wondering more about the

circumstances.

I know that in on County, the District Attorney often will protest a

proposed parole.? You might also ask local law enforcement to do the same.

He threw a hydraulic car jack into the path of our ambulance when we

were driving about 45mph. It went through the windshield and struck

my head. He confessed to the crime and was charged with Ag Assault -

Deadly Weapon. The plea included dropping the " Deadly Weapon " aspect

of the charge, and he was convicted of Ag Assault. While dropping

the " Deadly Weapon " aspect, he has to only spend 25% of his sentence

time instead of 50% with " Deadly Weapon " included in the conviction.

This deal was requested by the DAs office so that we could guarentee

the 7 year sentence on an 18 year old without any significant

criminal history. Difficult to accept at first, but I am ok with it

now. This is the biggest reason why we need to send protest

letters. I know that you guys can help.

Sorry, I forgot to include that I had a nasty laceration on my

forehead and also had a skull fracture. I had severe headches for

weeks afterwards, but luckily I can say that I have not had any " long

term " effects as of yet.

Thanks for the reply Donnie. I remember reading of the event now and have to say

a car jack is deadly just by being swung or thrown not to mention if you combine

the speed of a 45 mph truck. I hope you are okay and we all know you're feeling

lucky to be alive. Your partner, I'm sure, does too.

Speaking as an attorney (and former prosecutor) as well as a paramedic, these

sentences disgust me.? Until we get away from parole and " good time, " sentences

are worthless.? It undermines confidence in our criminal justice and legal

systems.? And it's why sometimes, juries get smart and sentence people to

consecutive 300 year terms.? Means they'll get out next week instead of this

week.

Don,

What Donnie did not mention is that he was seriously injured, could easily

have been killed, and spent a LONG time in the hospital and in recovery and away

from his job.

The scumbag who did this deserves to serve each and every day of his

sentence. Please write letters.

Texas needs to go to a " real sentence " system like the feds have. In the

federal system, you serve every day of your sentence minus some very slight

good-time incentives. It is a far better system than Texas has.

Ah but beware of how you word such a law. New Jersey has what they call a

" Truth in Sentencing Law " that's the title of the bill and the law BUT the

" truth " is if your given a sentence of X you must serve 85% and one ay NOT the

whole sentence. The guy that drove his car through a Mcs killing 3 and

putting another 3 in the hospital and totaling the building too boot got three

concurrent 10 year sentences so since they are " concurrent " and 10 years he's

eligible for parole in 8 and a half years plus a day.

Try explaining that to an at the time 12 year old girl whose mom is dead!

The magic is always in the drafting of the law. Judges do not like

mandatory sentences and neither does the criminal defense bar. However, a

statute

that gives a wide range of penalties but makes them absolute would fix that.

I am not in favor of mandatory sentences, since there are always cases that

won't fit nicely into the mold. Take California's Three Strikes law. It has

resulted in some ridiculous and unfair results.

But if the jury says 50 years, or the judge says 50 years, then 50 years it

ought to be.
