Guest guest Posted May 6, 2008 Report Share Posted May 6, 2008 Hey folks, I just wanted to update you on the process that I have been involved in for getting " emergency services personnel " (EMTs, Paramedics, and Firefighters) inlucded in the Texas Penal Code. More specifically, adding this phrase and definition to Aggravated Assault would allow the charge for this offense to be enhanced from a Second Degree Felony to a First Degree Felony for Ag Assault offenses commited against emergency services peronnel while on duty. For example: If a paramedic was assaulted by a subject while on duty, and he/she was assaulted with a deadly weapon and/or received serious bodily injury, the charge would be Aggravated Assault, a Second Degree Felony which carries a 2-20 yr sentence. The bill that has been drafted by Rep. Phil King of Weatherford adds " emergency services personnel " and, if signed into law, would enhance the penalty to First Degree Felony which carries a 5-99 yr sentence. The ground work was laid during the last legislative session by Rep. Bonnen who added " emergency services peronnel " to the Assault offense. This bill would ammend the Aggravated section of the Penal Code. Rep. Bonnen and Rep. King have proven that our legislators are willing to step up and prove to the citizens that assaulting not only peace officers, but EMTs, Paramedics, and firefighters will carry a hefty sentence. I will keep you guys posted as the bill progresses and when you should write your local reps so that this may be pushed through the process. D. It's wonderful for us to talk about our woes on internet lists, but these laws do not get passed unless many state representatives and senators back them. They won't back them if they have never heard from even one of their constituents about them. Donnie can't do this by himself. You can find your state rep/senator's names by going to http://www.capitol.state.tx.us/ and clicking on " contact my legislator. The Penal Code has a lot of " old verbage " included in it. For instance, Barry Sharp brought to my attention about the enhancement on murder charges to make it a capital offense. It states " police officer or fireman " . Now, how old is that?? That is just one example of work needed. Thanks in advance!!
