You son and his wife can file jointly, to take advantage of tax credits and such... His wife then files an "Injured Spouse" form, and the IRS cannot touch her share of the refund. Only your son's portion will be coveted by the child support people. H & R block would provide a report breaking down the refund eligibility of each party. Niece also states that if the wife provides 80% of the income then her refund would be 80% of the refund for an example. Hope this helps a bit more.
