Hi Listmates;

Today a 6 yr old boy with autism was left on a school bus for 6 hours. This brings back memories of my Miki coming off the bus naked and running around the buses pulling in the school yard. I wonder if they are waiting for a child to die before they figure out what the problem is here.

Frustrated, Jayne

To wit: a friend whose son is in a local ESE kindergarten class was

inadvertantly put on a bus in October. His mother always picked him up. The

boy got off the bus and was found standing on the corner, crying, and a mother

....took him back to the school.

The school system ignored the parent's anger and were told that there was

no injury so there would not be compensation. Of course, they listened when a

lawyer sent them a letter and he was sent to another school, happily.

The bus problem is more common that we know.

My son went on a bus twice from VPK to speech at an elementary school.

The second time he told me something happened and he didn't want to ride again.

He couldn't tell me exactly what...he WAS in a speech class...but it concerned

me enough to not use the buses again. Khat

Florida State Statute: FSS 316.6135 states the following about leaving

children unattended or unsupervised in a motor vehicle and the penalty of doing

so.

" No parent, legal guardian, or other person responsible for a child younger than

6 years of age shall leave such child unattended or unsupervised in a motor

vehicle for a period in excess of 15 minutes; however, no such person shall

leave a child unattended for any period of time if the motor vehicle is running

or the health of the child is in danger. " " Any person who violates the

provisions of subsection (1) is guilty of a noncriminal traffic infraction,

punishable by a fine of: Not more than $100; or not less than $50 and not more

than $500 if the motor vehicle was running or the health of the child was in

danger at the time of the violation. "

There are also " reckless endangerment " laws but typically a person has to

sustain an injury for those laws to apply.

What will happen is:

Next year the driver will be driving a bus again*

Next year the aide will be working on a bus again*

Both will receive " verbal counseling " regarding their breach of policy

There will be nothing in writing put into their files about this.

No criminal charges will be filed

(*if they want)

The District will intervene on behalf of the driver and aide with the police, it

was a mistake and the child wasn't hurt.

I will be happy to bet some good money this is how the outcome will be. Anyone

want a piece of the action?

Steve
