Can I use FL Insurance mandate towards a school shadow? Legal question!

My insurance company approved 40 hours of ABA/therapy under the FL Autism

insurance mandate/Federal Mental Health parity (we qualify for both - the latter

is supposed to be unlimited hrs). But they are refusing to allow us to use those

hours towards a school shadow/aide for my son going into kindergarden. I assume

its probably b/c they think that parents won't use all the hours if their child

is in school. We can use all 40 hrs, but only after school hours and on the

weekends. Are they allowed to do this? Does anyone know who I can ask? We have

to register at our Mckay school in 2 weeks, but since its a typical private

school they won't accept my son without a shadow.

Any advice is greatly appreciated!
