Maybe I am naive but I would have thought that Dade would have higher incidents of restraint than Broward because it is a larger district and perhaps less well organized. Also I thought Broward was supposed to have "better" quality and services when it came to kids with behavioral issues?

I honestly wonder if the only school district reporting properly is Orange. I don't believe for a second that there have been no incidents of seclusion in Lee (my district) at all during 2011. I have noticed since the law passed that my son is no longer " restrained " everything is now considered a " transport " so it does not have to be reported. My son has had no " restraints " this year, but I was flat out told he was the worst child in the district (thankfully he is now in private) If you look at the extreme length of time students are being restrained, there is no way you can believe these students are being released the second they are not a danger. How can you restrain a child for an hour, 3 hours or omg 6 hours?!?!

Hi ,

I should have noted that District's with less than 10 restraints or seclusions

are not listed. DOE said that was for confidentiality reasons.

My District (Broward) insists that they are reporting accurately and that Dade

is not. Staff here also told me that Orange is claiming that everyone else is

under reporting.

If you remove all restraints for less than an hour the statistics are still

alarming:

Dade 5

Broward 8

Orange 80

Orange County has half the sudents of Dade and Orange County uses a straight

jacket for restraint, see video.

It is VERY IMPORTANT to note that 44% 0f Statewide restraints were for PreK

through 3rd graders.

I am concerned that the accuracy of the numbers will become the focus of this

debate in Tallahassee instead of the fact that the statistics in hand indicate,

beyond a doubt, that we have a problem.

I was surprised to read in a previous email that a notice was supposed to go to the parents after each restraint.  I know my daughter was restrained numerous times at her cluster school and I have never received a notice regarding the use of restraint.

It is State Law that parents or guardians be notified the day the restraint or

seclusion occur. In 3 days you have to be provided with a written report with

details.

From Broward County Policy, but copied straight from State Law:

From page 4b

Documentation and Incident Reporting

1. Schools are required to notify the parent or guardian each time manual

physical restraint or seclusion

is used with a student with a disability. Such notification will be in writing

and provided before the end

of the school day on which the restraint or seclusion occurred. Additionally,

reasonable efforts will be

taken to notify the parent or guardian by telephone or e-mail, or both, and

those efforts will be

documented.

2. The school will obtain, and keep in its records, the parent's or guardian's

signed acknowledgement

that he or she was notified of the student's restraint or seclusion.

3. The school will prepare an incident report within 24 hours after a student is

released from seclusion or

restraint. If the student's release occurs on a day before the school closes for

the weekend, a holiday,

or another reason, the incident report will be completed by the end of the

school day on the day the

school reopens. The school will provide the parent with the completed incident

report in writing by

mail within three (3) school days after the student was manually physically

restrained or secluded.

My son was restrained at his new school the 1st week. Now they know him (I tried to explain his triggers at the open house) and love him. The teacher is great with him and she calls him her shadow. So that is one case. I'm pretty sure a new girl in his class went wild her first week, but I don't know how they handled that case. They called their security to take down my son (16 years 155 pounds). If that happened last or this year than there should have been a written report

delivered to you within 3 days, thats State Law.

As for you trying to explain about your child to staff, all too often they take

the SP (stupid parent) position. We are the professionals, we know how to deal

with your child, you're just the parent. I actually has an " autism specialist "

at a school tell me that once.

I wonder how many of the 459 restraint incidents that were counted last year in

Broward could have been avoided if the teachers had listened to the parents and

took appropriate action based on what they were told.
