Guest guest Posted March 20, 2008 Report Share Posted March 20, 2008 Hi Dodie I just applied and being anxious of having to come to terms that I am at this point, possible waiting 3 yrs, and then the amt of paper work that came to be filled out, it took me forever, in fact they sent me a notice I was running out of time, and could be denied if I did not get it back by the date, I just could not drag through it all at once. Good luck and take a big rest before applying if you have to go there.. Get yourself syched to be rejected, because they always reject you on your initial application ! And I had a slew of other illnesses besides the fibro. When you get your denial letter, which could take as long as 4 to 6 mos..Don't waste any time, get yourself a disability lawyer ! And anytime you fill out paperwork for the SSA, or anyone, your lawyer included, keep yourself a copy of whatever you send them.....Believe you me, it will make your life easier the next time you have to do it all over again...I got so tired of answering the same questions over and over on a different page...Then, your lawyer will ask for an appeal, you will most likely be denied again, and then your lawyer will ask for a hearing before a judge...Just have your story straight and make sure you have good communication with your lawyer, when I went for my hearing it was July of 2004 and I didn't get my approval letter till November of 2004. I got my back money about Dec. 15, and I started getting my regular monthly checks beginning Jan. 3, 2005. I think that they keep it going just as long as they can just to get you frustrated enough to give up, BUT DON'T , IT'S WORTH IT......I kept telling myself to be patient, it was really hard, but I did it....Hope this helps. They will call you and go over the forms, but they recognize the trick questions --- and believe me, there are a few of them. Read the info on their website -- you may not want to use them, but when I finally decided, I used them. I had called the year before to both Social Security and Allsup and from all of the BS I heard about what others had gone through, I decided just to let them do it!! It cost me 1/4 (actually less than that, but they were, just as I think lawyers are reequired to charge no more than a certain amount) But I quit working in Nov. 2004, if I had applied in 2005 I would have paid less, but since I didn't apply until Sept 2006, I got back pay to Sept. 2005, and Allsup treated the equivalent of one month's pay in 2007 as my payment for the month SS ruled I was disable, so they charged less than SS said they were entitled to. I know people who have gone through the process up to 3 times, one fried finally hired a lawyer to represent her the third time and she got it!! And I also know that we all are have a fear of dealing with those big bureauracies --- but they put on their pants the same way we do --- I just think they must suffer fast burn out and get nasty after awhile. I spoke to the adjudicator of my case two times --- first time, I said call Allsup, I can't talk to you; second time, it was just faster and easier for me to tell him where I had had any kind of xrays, ultrasounds, etc. done of my back/spine -- Allsup would have had to call me then call him back. I USED ALLSUP, I KNOW SOMEONE IN THIS GROUP WAS TOLD BY THEM, THEY WAITED TOO LONG, BUT WHEN I APPLIED IN 2006, I HAD NOT WORKED FOR NEARLY 2 YEARS. SO IF YOU DON'T WANT TO DEAL WITH THE BURNOUTS AT THE SOCIAL SECURITY OFFICE, START OUT USING ALLSUP OR A LAWYER!!! AND REMEMBER, THE FEE MAY BE 25% FOR THE SERVICE, BUT FROM MY STAND POINT IT WAS WORTH IT AND ALLSUP DETERMINED THAT THE PAYMENT I RECEIVED INITIALLY WAS FOR THE MONTH THE FIRST CHECK CAME, SO THEY ACTUALLY TOOK LESS!!!! AND ALSO, KNOWING HOW NASTY GOVERNMENT WORKERS CAN GET, YOU MIGHT ALSO, IF YOU ARE DOING IT ON YOUR OWN, CALL, WRITE, FAX WHATEVER YOU LOCAL REPRESENTATIVES AND YOUR SENATOR AND REPRESENTATIVE IN CONGRESS. IT'S AMAZING WHAT THEY CAN HAVE SOMEONE ON THEIR STAFF DO FOR YOU --- ALL THEY WANT IS YOUR VOTE. AND THEY DO NOT HAVE TO KNOW IF YOU VOTE FOR THEM OR NOT. EVEN TRY WRITING TO YOUR GOVENOR ---I KNOW FROM PERSONAL EXPERIENCE WHAT MY HUSBAND, AS A STATE EMPLOYEE AT A WELL KNOWN HISTORIC SITE, HAD TO DEAL WITH WHEN IT TRICKLED DOWN FROM THE WRONG STATE GOVENOR TO THE LOCAL REPRESENTATIVE. I had to apply right away per my long-term disability carrier (which I did); got denied the first time, they then set me up with their attorneys who filed the reconsideration, got denied again so they filed for a hearing which they said would be anywhere from 12-16 months from now. Of course, since the denials, I have added a few more diagnoses, including COPD with chronic bronchitis and asthma, fibro, a blood clot, chronic mono, diabetes and chronic fatigue syndrome. Most days I have the energy of a slug. Or a snail. I get stuff done but it takes forever! So I am very very hopeful that we will win at the hearing.......
