It may be a privacy issue, and if so, would be covered under your

provincial privacy legislation. You likely cannot tape children other

than your own without the consent of the parents/guardians of the other

children who would be in the tape.

Ok thanks for answering ;) It's not what i was hoping to hear though. I

find parents are videotaping their kids in christams concerts and plays

and also outside etc... and noone said anything to those guys. The

minute my kid is targetted and i say i will tape to prove to you that's

not the case - it becomes illegal ;( I feel very unlucky . I wish i had

loads of money to take this issue to court ! Tina

I don't see how you can expect privacy when you are in a public

place... Strangers (including children) get captured in videos and

photographs all the time; there's just no way to avoid it. It would

be illegal to take pictures or video your kids anywhere: the zoo,

park, beach, etc. unless they happened to be there alone.

I don't see how you can expect privacy when you are in a public

Oh, please don't give up yet based on what I said! Here's what I'd

try if I were you:

1. Demand that the school provide you in writing with its reason to

justify saying videotaping is illegal when it is done by a parent,

not by a teacher. (It is the schools that are covered by privacy laws,

not the parents.)

2. If the school doesn't provide you with something in writing and/or

if it says orally that it's " privacy " related, do one or more of the

following (they may not work, but again I wouldn't give up just yet!):

(1) complain to your provincial privacy commissioner about the

school's apparent breach of privacy policy if it is permitting

videotaping in some cases but not others; and/or (2) complain to your

provincial human rights commission that that school is discriminating

against your son on the basis of disability, in that you have been

prevented from videotaping him simply because of his dsability; and/or

(3) complain to your school trustee.

You don't need a lawyer to lodge a complaint at any of these levels.

alot of school as parent permission for video taping at the beg. of school year

.. They are usually general requests vs for specific events. So perhaps this

covers the school legally.

Oh, please don't give up yet based on what I said! Here's what I'd

try if I were you:

I'm just wondering why you think the school is dishonest (have there

been other instances in which they have been?) and why you're not

willing to listen to their concerns about your son. I don't mean to

be argumentative, but I do think maybe, for the interest of your son,

you should hear what they have to say. My son was being agressive in

some situations at school and it was the school's concern about this

agressive behavior, which was totally out of character for him, that

allowed us to get him diagnosed with Sensory Integration Disorder

which was totally the reason for this agressive behavior. Naturally

I wasn't thrilled to hear negative things about my dear child from

his school, but I'm glad they drew my attention to it so we could get

a diagnosis. We've been doing OT for 8 months now and it's made a

huge difference. The agressive behavior is all but gone.

Also, it troubles me that you don't trust your child's school. Do

you have other school options? I really just mean to give you

another point of view, not to criticize you in any way.

I called human rights commisison today - it's legal as it pertains to

my chiild, and we just have to blot out faces of other kids . Period.

The school is trying to lie to me, due to afraid of what i will catch

on tape... and they say that my kid is a bully (this is truly not my

child) and then they cower and worry when I say i will go check up on

them and it becomes 'unwarranted'. Please... if they will lie about

my chidl, every step I take to protect him is warranted, because he

can't speak up for himself .

And I have spoken to his friends at teh school, and they tell me that

he is the one being bullied, my little boy is first bullied, then

dragged inside by the Monitor like a criminal and then reprimanded by

the teacher . So , now he can't speak up for himself and the Monitor

is bullying him? She's a coward. Because she won't be able to stand

up to me i gaurantee this. and she will have to answer to me in the

New year.

Hi, I understand and respect your point of view and this will be my

last email on this subject since I have my answer , I don't need to

discuss this any longer.

However, I do know my child and there have been many occasions the

school has been dishonest with us and we have proof . And getting a

video tape of my child at recess should prove them right or wrong

and same goes for me - so it really shouldn't make them

feel 'threatened' should it? .

However, I have seen my child be bullied, and unfortunately, he did

not retaliate in those circumstances . It was a period of 2 months

that my husband and I supervised our son with his cousin , becasue we

were embarrased to tell his mom (my sister) and boy did I wish my son

would retaliate , but he never did. He is kind, loving and gentle and

a sweetheart. Also, when the school claims that he hurt another

child, I verify with chidlren from the school and they tell me that

it was my son bullied... so this is very 'questionable' to say the

least.

SO, that being said, one way or another I will get to the bottom of

this 'problem' . Also, there is a rule here that if a child is a

danger to himself adn or others (and the school board can prove this

or at least make a case against my son) then we would not have the

option to keep him in regular mainstream - he would immediately be

sent to a retarded/autistic school, and this is not his diagnosis and

would be an inappropriate setting for him .

That being said, I have every right to find out the truth and I

will ;)

voice and advocate and I will advocate for him. Not blindly believe

them or any thing they say , and I trust my instincts and know him

best .

I would videotape so that you have proof of that is going on. I dont know

the laws in Canada as I am from the states. Sometimes it is hard to trust the

schools. I wish you the best of luck I know it must be hard on you and your

family.
