Many attorneys I have had the opportunity to work with in conjuction with planning for special needs families, do not advise using these prepaid college or 529 plans. I think the issue comes down to- who is the owner of the account? If established by the parent or grandparent, they are the "owner" of the account. Your special needs child is the beneficiary. So what happens if the parent or grandparent passes away before it is determined that the child will go to college? If the funds are used for college, I'd assume there would not be an issue. What if your child is over 18 and receiving government benefits, and decides not to go to college? Would the child be able to withdraw the funds? If the funds are available to the adult child, this could cause an ineligibility for SSI and medicaid. Perhaps you can name a contingent owner. But do you see how this may become problematic? Not to mention, there are also tax consequences when withdrawing funds from these education accounts when the funds are not used for education.
