In some cases you can be denied the benefit if you do not give your employer proper notice. You can view the facts about the same at the US Department of Labor website: http://www.dol.gov/dol/esa/fmla.htm I told my employer of my previously scheduled surgery and they were less than pleased indicated by several remarks and roadblocks from a supervisor in the department. They gave me the distinct feeling that hadn't I fufilled my legal obligations of notice, etc. they would have denied me the FMLA benefit, which would have been at their discretion in that case. Fortunately I had done my homework and they knew it. Unfortunately, I had to renege the notice since my surgery was canceled for now. Thus, I am not thrilled with having to go back later and revisit this issue. I don't know the atmosphere you work in, but I would rather be safe than sorry given the circumstances.
