Guest guest Posted June 1, 2012 Report Share Posted June 1, 2012 Hello, My second son was born in March 2009, his evaluation meeting with the school was held in March 2012 before his third birthday. The Broward School Board sent me a letter saying the IEP would be held the day before his third birthday. I requested another date and time on the IEP form, but they held the meeting without me anyway. I declined school services in March because I was able to get my son intensive therapy using insurance and funds from my retirement. I received a letter from the School Board saying that my sons records were being transferred to FLDRs so they would be available when he is ready to start Kindergarten. However, with the financial stress have two children with autism carries, and issues related to his current daycare situation, I thought it best to have my 3 year old start school in the Fall. I contacted the school board about a week ago to request that my 3 year old attend Baudhuin in August, as his older brother had done the year before. I was told he could not go to Baudhuin because he was already assigned to another school. I only found out 3 days ago that he was assigned to a school back in March, and it was not Baudhuin. So even though he has never attended any school they will not let him go to Baudhuin - which now has space available, because they say they do not do reassignments for Pre-K. So in short, because he was born in March and Baudhuin was full when they assigned him to a school in Mach without my presence or knowledge - he does not get the opportunity to be eligible for Baudhuin - is it just me or is this really unfair and just wrong? I think that this new reassignment policy is discriminates against my son because he was born in March. Eligibility for Baudhuin should be based on the individual’s need and the family need, not on the birth date or bussing budgets. Families that have more than one child with autism (like my family) should automatically be eligible for Baudhuin. Children that are very low functioning, for example have a score of less than the fifth percentile for the Battelle Developmental Inventory (like my son) should be automatically be assigned to Baudhuin regardless of their date of birth. Please let me know if you can recommend a good lawyer that can help me. I do have legal insurance with Hyatt Legal (www.legalplans.com) through my employer, so it will be ideal if someone can recommended an attorney that is in network or will do pro dono work. Thanks in advance for your responses, as we all know how financially stressful having a child (never mind 2 children) with autism can be.
