I wanted to ask if you set up a Florida pre-paid college fund for your kid with

autism without having a special needs trust fund, would that money be counted

against him to receive government benefits? Thanks, Ida

A Florida prepaid education account would certainly count as an asset of the the

special needs adult child when maintaining eligibility for Medicaid or SSI. If

you do not have another child to switch the funds to, it would be much preferred

not to have college 529 plans or prepaid college accounts. Put the money in a

special needs trust- this is the most flexible way to save for your child's

future, and if your child does not go to college, you can use the funds for

other purposes.

Many attorneys I have had the opportunity to work with in conjuction with

planning for special needs families, do not advise using these prepaid college

or 529 plans. I think the issue comes down to- who is the owner of the account?

If established by the parent or grandparent, they are the " owner " of the

account. Your special needs child is the beneficiary. So what happens if the

parent or grandparent passes away before it is determined that the child will go

to college? If the funds are used for college, I'd assume there would not be an

issue. What if your child is over 18 and receiving government benefits, and

decides not to go to college? Would the child be able to withdraw the funds? If

the funds are available to the adult child, this could cause an ineligibility

for SSI and medicaid. Perhaps you can name a contingent owner. But do you see

how this may become problematic? Not to mention, there are also tax consequences

when withdrawing funds from these education accounts when the funds are not used

for education. So, while I agree in most cases these prepaid college and 529

accounts are excellent options for college planning, tread carefully when naming

a beneficiary who may need government benefits.

area of special needs, including special needs trusts and guardianship. Call me
