We discussed it years ago in the ESE Advisory and it hasn't gotten any better and now its news again? Do you think that the ESE administration hasn't known this was a problem and chose to ignore it for so long? They told all the ESE specialists at their start of the school year meeting that they had to include ESE students on class wide field trips. When asked why this was still occurring last year the response was " we can't police 260 schools. " I believe what happens is that the schools that have a history of this lazy and illegal behavior just backslide into their old ways. This is discrimination, should not be tolerated, and needs to be addresses with the principal and the District as soon as it occurs. An Office of Civil Right complaint would be in order. This is why we are taking on this issue...and collecting data as we will move forward and " motivate " the district to do something about it. I have very good confidence that we can make it better for our ESE students regarding this issue. We will keep families updated on this issue....very soon. Guest guest Posted December 14, 2012 Report Share Posted December 14, 2012 As a parent of a severely special needs child who is in the Broward school system, who was in a harness until last year and now uses a seat belt and as a tour operator who handles in state and out of State field trips for Broward County school, I need to express something to you all. I don't no what schools are not allowing these children not to go however, I have come across issues because the buses are NOT equipped for students who are in Harnesses.There are NO buses on the Broward County RFP list(and I am talking motor coaches) equipped to handle a Harness. Only wheel chairs accessible as well as buses, with seat belts and there is even a bus company that has a 3 point seat belt. But NON of these buses are equipped for a harness. Only School buses are. However they do not go out of the Tri county area. Parents who students are in a harness and what their child to attend an out of county field trip that does not include Dade Palm beach or West Palm where we can use a school bus have to make a decision. The parent must either drive or signing some form or a waver that allows the child to sit in a seat belt or 3 point system with an adult next to them. Or follow the bus with your child in your car. The motor coaches are not and will never be equipped to handle harness. This option: "  signing some form or a waver that allows the child to sit in a seat belt or 3 point system with an adult next to them. " seems a reasonable option. A liability release is a violation and not necessary regardless of what the school may say. The District must provide whatever supports are necessary to include disabled students on classwide field trips, PERIOD. This is basic civil rights, and is clearly spelled out in Federal Law, State Law, FLDOE Rules and District Policy: It's like on page ONE of the rule book: http://www.fldoe.org/ese/pdf/1b-stats.pdf 1000.05 Discrimination against students and employees in the Florida K-20 public education system prohibited; equality of access required.–(1) This section may be cited as the " Florida Educational Equity Act. No person in this state shall, on the basis of race, ethnicity, national origin, gender, disability, or marital status, be excluded from participation in, be benefits of, or be subjected to discrimination under any public K-20 education program or activity, or in any employment conditions or practices, conducted by a public educational institution that receives or benefits from federal or state financial assistance. To take the survey click here. http://browardeseadvisory.com/Survey.html Its all about the kids and common sense. - Example: If a child would be completely miserable the WHOLE trip at Disney World in February (season period) because sensory issue...and that the only time he enjoy the trip is when he sleep (if he does sleep) then a field trip might not be recommended. Its all about the child....but if the fact that the parent would help in that situation and make it possible for the child to go.....then ALL(elementary-middle and high) schools should allow the parent to go. - If a child has behavior problem and they are " outbust " this person should be allowed to go on field trips with the right " trained staff " to deal with the situation. Bottom line....I dont see too many reason for students not to be allowed on field trips....unless the student would be miserable the WHOLE time. If the student can be made comfortable to go and enjoy the field trip.....then support should be provided. PARENT SHOULD BE ALLOWED TO GO ON THOSE FIELD TRIP IF IT WOULD MAKE POSSIBLE FOR THE CHILD TO GO AND ENJOY THIS EXPERIENCE. PARENTS SHOULD BE ALLOWED TO GO IF IT WOULD MAKE A BETTER EXPERIENCE FOR THE CHILD.
