I spoke to two different attorneys, got both sides of the story, and decided that for my child, the reasons were more compelling to go for a full guardianship. If they can't vote or drive they might not now but maybe some time in the future they may. So you leave the door open. But the important issues - money and medical the guardians look after. It depends on the functioning of your child. Is he/she able to make their own decisions? Drive? Vote? Medical? Where they want to live? Handle money? If not then you would want full plenary guardianship. Go online and check out the explanations. Guest guest Posted May 5, 2012 Report Share Posted May 5, 2012 The type of guardianship that you acquire for your child absolutely depends on their level of functioning. If you have a child that you feel needs ongoing supervision in many avenues, you should get plenary guardianship. This will actually protect your child from other people who could take advantage of your adult child. One thing that Plenary guardianship protects against, is people who will coerce your child into marriage to gain control of them and their social security check. This does happen. If you do not have plenary guardianship, you as the parent, have absolutely no ability to stop the marriage from happening if your adult child says that that's what they want to do. You can always change the level of guardianship later in life if you feel your child has progressed. One of the problems with some of our adult children, is even though they may have a lot of abilities, they lack the judgment to make certain decisions that greatly influence their life. There maybe some individuals who think they think should get a drivers license, but perhaps it's not such a good idea. Guest guest Posted May 5, 2012 Report Share Posted May 5, 2012 Yes, Guardian Advocate is for individuals with developmental disabilities...you advocate and the idea is that the individual can reasonably give input and participate, so their rights are left intact. Some of the young adults on the spectrum can not express what they need or how to manage all aspects of their lives, can not meaningfully exercise their rights, so the full plenary guardianship may be the more appropriate avenue for families in those situations. It should also be noted that if you are ever contemplating leaving Florida you may have to do the whole guardianship process again as other states do not have the guardian advocate. Full plenary guardianships come with additional requirements to the court but for some it is most appropriate choice. THERE IS NO ONE PERFECT METHOD FOR ALL.....
