If your company is subject to the FMLA (has enough employees), and if you qualify (have worked enough hours in the last year), then FMLA should protect your job for up to 12 weeks in a year. However, I'm using FMLA and am in the midst of being laid off. I'm not really up to the task of working full time or even part time, so I don't know that I could fight this. Although this is a lay-off. Several others are also being laid off, but 2 people get to keep their jobs and work remotely. Something about this stinks, but part of me knows I can't work. Not too many people are willing to hire someone even part time who can't be very productive due to fatigue. I have seen people use FMLA for depression. The wording must done carefully on the FMLA aplication, at least here in MD. I knew someone who used it for chemo/radiation treatments, doctors appointments, etc. I believe it's a good thing!
