Guest guest Posted April 11, 2008 Report Share Posted April 11, 2008 Hey friends I am coming to you to vent and I hope that it is ok. First of all it is a very bad fibro week for me. I so very very tired and my body is hurting so badly. My mind is having a rough fibro week, it just seems that I am barely able to function these days and now I have added a new stress to this horrible disease. My husband just went to the bank to get the money for our supper and he is told that there is a $7000 garnishment on our checking account. Until it is paid in full we will not have a penny to our name. I had written a letter to these people and tried to make arrangements to pay this at a $200 a month payment, In fact I was told it was paid off. Only to find out that they underhandedly did this behind out back. SO now I have a family of 11 children and mother and both of us to feed and we have no money in the bank to cover the bills or the checks that I have already written. Our entire family is now upside down. I do not understand how any one could be so horrible and do this to any one. I am so upset and y heart is in my stomach and I really really don't feel like it will be ok this time. I just do not understand how we are supposed to care for our family, Pay any of our bills or anything else with this Happening to us? How do we feed our family or pay for our house? This just cant be happening. When does the Lord let up and let you see the sky again? How do I tell him that I cant take another second of this , I have been tried over and over and just don't feel like I am going to make it through any more of this. Please be in prayer for us as we try to figure out how we will be able to deal with all of this and take care of our family once again. I don't know what state you are in, but I had a debt collector garnish my checking account in 1998 but I got the money out because they made a mistake and temporarily lifted the garnishment for a day. They garnished my account again about four years ago but there wasn't much money that time and they got it. I had to file bankruptcy to keep them from doing it again. I just wanted to share some info. w/you in case it is of any use. I don't know exactly what your situation is, but I was told by a lawyer that these debt collectors sometimes freeze bank accounts when they're not actually allowed by law. For instance, if the debt was originally only in you OR your husbands name, one or the other, not both, then the creditors cannot legally garnish the bank account that would be in both names because it is marital property. If this would be the case, you can contact a lawyer & have the account unfrozen. If this wouldn't apply to you then, if whomever works in your family has direct deposit, have it stopped immediately so you can get your money. Also, could you open an account at another bank if necessary? I was also told by a lawyer that if there's a possibility of an account being frozen that it's not illegal to give the creditors the info. they request about your current bank accounts, then go down the road & open new accounts at another bank & change your direct deposit there asap. Of course, I don't know all about your situation, but these were just some things I wanted to pass on, just in case...because my husband & I came close to this happening to us as well. I'm sure all this stress is doing a number on you physically. I know these times are impossibly hard. Try to remember that everything will eventually pass... I would also contact Legal Aide and see about declaring bankruptcy on this debt and of course, PRAY and I will join you in that. I pray that the best of things will come your way. I would think it would be illegal for anyone to take that money form you since it is meant for them. Do you know a lawyer you could ask? WHO has the right to do this? Is it the IRS? that is the only people I can think of that would have the legal right to do such a thing. Oh, sweetie, that is just the most horrible thing I have ever heard of. And... I thought that if you were making some kind of payments, they could not garnish wages this way or take money out of your account. First of all, the next money any of you recieve, do NOT put it in the bank. Cash the check and keep the cash. The world is full of people that don't give a damn about anyone else. I realize that it is our obligation to pay our bills, but sometimes circumstances happen that don't allow us to. If I have to choose between feeding my kids or paying a bill, my kids will be fed. I thought garnishments were taken a set amount a month over time, say taken out of a paycheck or some other income. I think you need help from a lawyer in this situation. I know they seem so expensive but I have found that under certain circumstances they pay for themselves by the amount of money they save you. I have been in bad situations before and didn't hire a lawyer and ended up in worse shape than before. Because of a bond taken out for improvements by my condo association they assessed a fee from each owner. I couldn't pay it all at once and was told by phone that paying it over time would be OK. But before I knew it I had a letter from a lawyer saying the condo assn was going to foreclose on me because I had not paid it in full and no partial payments would be accepted. I thought I could work this out and talked to my mortgage company and they said they would pay it to protect their interest if there was a judgment, which they didn't think there would be. So the proceedings continued until the amount went from $2000 to $14,000 and then the mortgage co paid it off. I learned that phone conversations count for nothing also unless they are from a lawyer. I was told that the amount of money I owed to my mortgage company, because they paid off the condo assn, would be either tacked onto the end of my loan or refinanced into another loan. Instead after doing nothing for several months, they filed foreclosure proceedings out of the blue. This time I hired a lawyer and he has kept the amount from going up and he has only cost me $300. I borrowed money to pay it off and am now selling the condo as soon as I can get it cleaned out. I need to get out as soon as possible and have no idea where I'm going afterward so I know how you feel about being scared. I'm so sorry you are having to go through this. What a terrible scare. Can the income you make be routed to another account or gotten in cash so you can use it and just let the amount sit with the bank? It doesn't seem right that they could take everything. I will definitely pray for you and for you situation to be straightened out in your favor. You have 11 children? Wow what a lot of mouths to feed. And you said your mother too? You sound like a really caring person. Please know that you are being prayed for and you are in my thoughts with many well wishes. I also hope you feel better. The creditor / debt collector does searches to find the bank accounts and assets of the debtor. Once they find the bank accounts they have a computer system that sends pings to the bank account to determine when the debtor is paid. Then they lock the account down on payday when the account has the most money. In Texas they can do this if there is a judgment against the debtor. Bankruptcy or payment in full is the only way to stop them. I had to cash my paychecks at a check cashing store. Guest guest Posted April 12, 2008 Report Share Posted April 12, 2008 Taking money from a checking account is not actually a garnishment...it is an attachment. And yes, as long as the company has a court order they ARE allowed to attach a checking account and can take any money out of it until the debt is paid. There are some rules if it is a joint account UNLESS the husband and wife live in a community property state and then I believe they can still take the entire amount of the account. Rise, please first thing check with a lawyer about the ownership of the account and definately have them check to see if the company doing the attachment has a COURT ORDER allowing them to do that. It is not the banks fault, if they were served a court order they are bound by law to follow it and could face harsh penalities if they didn't. Same with garnishments, it kills me every week to have to take 25% of some of our employees paychecks and send it to garnishees every week because I see how little they have left to live on.
