Guest guest Posted July 24, 2007 Report Share Posted July 24, 2007 If anyone knows how Social Security benefits can be collected for our kids under age 18 years, I'd like to know so I can try to file for back benefits for my child, Katy, who is now age 19. Over the years I applied on behalf of my daughter with Charge and was told over and over that we made too much money. Even when she turned 18 yrs old (I was divorced by then)they said no because she's still in public high school and living at home on my income and $500/month child support. NOW, as in this summer 2007, I made an appointment and went down armed with a whole bag of information and Katy with me and the ball is FINALLY rolling. She has been assigned a medicaid ID number, and her SSI paperwork is being reviewed. Get this, they sent me the following: A survey for her speech therapist to complete; a survey for her teacher to complete; a survey for me to complete; and a survey for Katy to complete - with (thankfully) instructions stating she could have assistance filling it in. So I had to run around and find a teacher (luckily summer school was in session) and then for the speech therapist at the hospital to fill out the survey, I had to have Katy sign a form giving them the OK to release the info to the SS office. Katy is 19, so the HIPPA laws apply. All I can say to those of you with young kids, is good luck. I've got a ton of medical bills for services, equipment and supplies that weren't covered by the insurance company. It's like there's nothing out there to help those of us who want to work and support our families who are faced with ridiculous medical bills. Thanks for the opportunity to vent. I don't think so, but SSI only help people who could only live with 8 grant a year per person, in our case not more than 32 grant a year, How we are going to survive with 32 grant a year? ridiculous right We have being dealing with his problem since august last year, we still hanging in there sometimes the system it's wrong and you have to learn how to deal with it with or without help. Guest guest Posted July 25, 2007 Report Share Posted July 25, 2007 Hi Bobbi, This is NOT a definitive answer, just our experience as best as I can remember. was on at birth and some time after, through the Kaleigh Mulligan law (a Massachusetts state law, or federal???) which said that without supports she would have to be institutionalized to receive life-sustaining care. We had private insurance, and earned too much money, so I don't even know why we qualified, but she got her checks and MassHealth. Then they said she didn't qualify, and attempted to collect what they'd paid. I had to go in and make a case to the office that it was impossible to make any pay back, so they waivered it. Her Dad and I separated when she was 8. I wasn't working, and the child support did not put us over the guidelines. That qualified her again, and they paid the 2 months back to my original request date for this period. And she continues to be on, however, I put 8500.00 in my account from an auto insurance settlement that belonged to my son-and within a couple of months, they reduced her check by 75.00 till they collect the 3500.00 that they paid when we didn't qualify when she was a baby. (Whew). Unless the check now comes in her name only, your income and your assets will always have to stay under the guidelines. (I recently changed 's to her name only, and needed a doctor's ltr stating she is competent to handle her own money, which isn't exactly true.) As far as recouping any monies they may have owed prior to the first check they issue- 1. they'll go back to the date you applied, and 2. if you/she were elligible (financial limits) at that time when you applied. I had to hire an attorney to prove my child would be in life long care of parents. Before we applied (again) our attorney had me complete forms to request every single piece of medical on Jillyan -- on paper she looks much worse -- but she will always be in our care. Once this was complete we applied for SSI, got denied and our attorney filed an appeal. He went before a judge with the encylopedia on our child. SSI was granted ($30/month) and then what I wanted -- Medicaid. Now they only back dated her to two years so I pulled all the bills and asked them to file with Medicaid for some of the out of pocket and deductibles that I was out. I had something like a 90 day deadline to accomplish this and then I could go back no more. It is ridiculous that you have to go thru the process but I kept running into these housewifes at dr's offices dripping in diamonds and could not figure out how they had Medicaid. Finally I just asked and that is how I found out. Hope this helps.
