I AM sympathetic to doctors who are afraid of being sued, but NOT at the expense of a patient's medical care. You should tell him he should be more afraid of being sued if you dropped dead because he DENIED you the care. Recently, at clinic, the woman next to me was there to have staples taken out. She made the comment that she had told her husband if " anything went wrong " to sue, she didn't care what she had signed. Now, people, I am a lawyer, but it made me furious. I said, " you have got to be kidding! You couldn't BE any more informed about the risks of this surgery. Dr. R is not GOD, he is a surgeon doing the best he can, things happen...that he is not responsible for " . People should be held responsible when they screw up, NOT when people don't get the results they want. I swear, if she had been pre-op, I would have told Dr. R. We lawyers get a bad rap sometime, BUT I was stunned. SO I do understand why many doctors are scared to recommend something that they don't understand, but that is so wrong to do it at the expense of a patient's well being. I was in a big law suit that took almost 4 years of litigation I was not the problem but the jerk sued everybody he said hi to.lol I spent $13,000 on attorney fees, I should have countered sued for fees. IM just not like that, although I never knew it would drag out for years. He lost. I can't say I won because I ate myself into obesity over those 4 years. It is a hopeless feeling when you have done nothing and you are forced to defend yourself. I cried when my attorney called me and said its over, then I wanted to celebrate, it was like a car was lifted off my chest. It took me a long time to get angry, there were about 8 people in the suit the main 2 companies did not even show up. Now IM OK, but when they ask me the same question over and over again It drove me nuts, I didn't have an answer, because I didn't know. Then the other attorney said she took three pages of print and still did not answer she must be lying, I was really getting mad, I did not know the answer to his question so he called me a liar, that is just not fair. My integrity is everything to me. So everyone lost. We need to change the laws in this country, you have to be responsible for the action you take. However you should not be able to sue and destroy peoples lives without a great reason and you should be punished if you do so falsely. This jerk said to me sorry honey you were in the wrong place at the wrong time and then he chuckled. I would have spit on him if I could have. Guest guest Posted May 1, 2000 Report Share Posted May 1, 2000 Natty, that's like , only jauntier, I work for lawyers, I would never sue a doctor, who wasm acting in my best interest, I even told him that, I have calmed down now, and am starting the search for a new Dr. Yes I can understand the fear Dr's have of malpractice, and I respect that, but my PCP should have told me that 3 months ago when the liar agreed to support me in this decision.
