Include these with your appeals. If you don't have a written Exclusion in your policy, and you include letters of medical necessity, it's been my experience that this does the trick. Once surgery is considered medically necessary, it is no longer an " elective " surgery and out-of-network becomes a possibility. Letters of medical necessity are very easy to get. Write them yourself then fax them to your docs and ask them to sign them & fax them back. When I do this, I usually have them back in one day. Then you will have your ammunition....
