Guest guest Posted January 20, 2005 Report Share Posted January 20, 2005 Does anyone know if an insurance company can legally kick out a dependant when the employee switches the policy over to COBRA? I thought they were legally obligated to continue coverage for the entire family if we pay the premium. It appears that our insurance is trying to kick me off my husband's policy Feb 1 when we switch to COBRA for 2 months. His new insurance does not start until April 1. It's possible this was an " error " but also is possible it was deliberate. I know my file has been flagged as expensive due to various situations, but did not think they could actually kick me out even if they wanted to. Anyone have any experience or knowledge of such a situation? It is creating a major problem with the Gamma Knife, among other things, and if I can't prove continuous coverage, then the new policy could potentially refuse to cover any pre-existing conditions.....which would be a true nightmare.
