I know it won't help, but we had a very similar situation - also to do with the road and with 3 days to go our solicitor insisted on a retention from the buyer (S*d off was their reply) or a cash deposit from us of £2,000, which in the grand scale of moving isn't that much, but when you've budgeted for every penny of your savings trying to find £2,000 1 day before exchange and 3 days before we moved wasn't much fun. BUT we did move, (did find the deposit, which got repaid 2 years later) and it all worked out fine.
