DNR, criminal history rules effective July 6

The rules arising from the change in statutes in the 2009 Legislature

became effective July 6. Amendments to 25 TAC, Sections 157.25, 157.36

and 157.37 implement HB 846, HB 2585 and HB 2845.

DNR rule changes: The amendment authorizes digital or electronic

signatures and a notary's acknowledgement for certain signatories for

advance directives, including DSHS's Out-of-Hospital Do-Not-Resuscitate

form. The new OOH-DNR form is available on our website at

www.dshs.state.tx.us/emstraumasystems/dnr.shtm. Remember, OOH-DNR forms,

no matter which version, are valid until revoked or the patient dies.

EMS personnel/criminal history rule changes: The amended rules provide

guidelines to the department for prescreening, revocation, denial and

suspension of licensure or certification for personnel with specific

criminal records, and it may prevent individuals with certain criminal

histories from entering the EMS profession. It also limits a renewal

applicant's requirement to provide any unchanged criminal history

information already included in a previously filed application.
