The thing is that I know a lot of people who would love to open bank accounts, but they don't have INS papers, and wouldn't be able to get any. Although it is an admission that you are not eligible for a social security number, it doesn't mean conclusively that you are undocumented. The tax report does of course indicate that you have worked, and if you include wage stubs that use a fake social security number, that could expose you. We are not aware of anyone being turned in to INS either by IRS or by the Social Security Administration on this basis. And the good thing is that if you file income tax using the ITIN, you can get any refund for which you may be eligible (though not the EITC). The purpose of the ITIN is to allow people who can’t get a social security number to file taxes. Or, someone who has a SS number but whose dependents can’t get SS numbers can get an ITIN for the dependents, so that they can claim them as dependents. Please note that you cannot claim the Earned Income Credit using an ITIN. (Many farm workers are currently in trouble for doing that, usually with the help of notarios!) Undocumented people should file taxes because they might get a cash refund, and because if you owe taxes it is against the law not to file an income tax return. In addition, they may be eligible for immigration benefits at a later time, and for most immigration matters you must prove good moral character. Filing your tax return can be a factor in good moral character. Here’s some general information on the ITIN (Individual Taxpayer Identification Number) taken from a know your rights flyer by the Tennessee Taxpayer Project: You do not need a SSN to file a tax return and get a refund of your income tax. You can get an ITIN if you are not eligible for a SSN. The IRS can give you an ITIN. You can give the ITIN where a SSN is required on your tax return. ITINs are for tax use only. The ITIN does not affect your immigration status or your right to be legally employed in the US. To apply for an ITIN, file form W-7, Application for IRS Individual Taxpayer Identification Number. You can file the W-7 with the local IRS walk-in office. You can also mail your W-7 application to: Philadelphia IRS Service Center, Attention: Drop Point 2840, Post Office Box 447, Ben Salem, PA 19020. You must attach an original or certified copy of your passport, driver’s license or birth certificate to the W-7 application. (Obviously, it does not have to be a U.S. birth certificate, etc.) If you take the certified copies or original documents to the local IRS walk-in office, the original documents will be returned after a brief inspection. After you file your W-7, it takes about 6 to 8 weeks to get your number. Will Using an ITIN get me in trouble with the INS? The IRS cannot generally request the names of taxpayers using an ITIN. The INS can use the ITIN as proof of illegal status only if there is an ongoing investigation of your immigration status. For free tax assistance from people trained by the IRS, call 1-800-829-1040 and ask for the location of a Volunteer Income Tax Assistance (VITA) or tax counseling for the elderly (TCE) site near you. Note: This information cannot take the place of advice from a lawyer. Each case is different and needs individual legal advice. I hope that clears up some questions about the ITIN. The Tennessee Taxpayer Project will soon be sending me an electronic copy of the informational brochure from which I excerpted the above. If it would be helpful to you, I can email it to you. Also, the Legal Services program that serves farm workers in your state should be able to take referrals of farm workers with tax questions and other legal questions.
