To be honest though....noone ever asked me for a prescription when I bought mine. Supposedly, you are supposed to have a script to buy O2, and adjuncts as well, But I have never been asked for one. Guest guest Posted March 30, 2011 Report Share Posted March 30, 2011 There are two references to physicians in the Texas AED law (ch 779.001-007 of the Health and Safety Code): 779.002 talks about the training program, and says: " (2) a licensed physician is involved in the training program to ensure compliance with the requirements of this chapter. s a licenses physician must be involved in the training program " . This is usually taken care of by having physicians involved in the development of the guidelines and training materials at the training agency level; 779.007 is about prescriptions: " (1) the automated external defibrillator has been delivered to that person or entity by a licensed practitioner in the course of his professional practice or upon a prescription or other order lawfully issued in the course of his professional practice " For workplace AEDs, that's the only physician involvement needed. There are some notification requirements we have to do, like notify local EMS that there is a unit there. And we won't place an AED unless (1) it's mounted or otherwise has a definite location (if a portable unit). I've seen too many stuck in a cabinet somewhere that no one can find. So we make sure the new AED has a home! (2) Training has to have been done, or scheduled. Not required by law, but a good idea (you wouldn't believe all the dead AED batteries we find!). We call it a service contract, but the same thing as the oversight from the vendors and national organizations except we actually come on site to inspect the units, usually 2 times a year. And its up to the distributor to get the RX, and a lot forget it. I've never heard of anyone getting gigged, but it could happen.
