Guest guest Posted June 7, 2000 Report Share Posted June 7, 2000 Hi, Tomorrow afternoon I go for my final appeal at MAMSI Life and Health Insurance Company. I have been denied because of exclusion of contract, not due to medical necessity and from what I understand, these are very seldom overturned. I spoke with a man in the NC office for the ADA and he said that as long as they had never paid for anyone to have weight loss surgery, then it would not be considered discrimination as the courts have upheld denials like this before. You can't make an insurance company cover something. However, he did say that if they have paid for weight loss surgery before, then I would have a stronger case. If ANYBODY has overturned a denial because of exclusion of contract, PLEASE e-mail em before tomorrow at 2p. Any help and suggestions would be very welcome as well as some prayers at 4 pm.
