I quess you're saying to yourself, it has. However, I hope Pete is doing better. I was reading your post and yes u are correct, SSD has nothing to do w/your income. However SSI does. When I applied for SSD in 1995 I had no income from a job and I couldn't get the Supplemental Social Secure Assistance because I was rec'g Disability Retirement from the Federal Government and a Disability Income from Another Source. This disqualified me for SSI benefits. If I did not have any other source of income I would have rec'd SSI until they approved my SSD benefit. It took me approximately 3years to get my SSD. However, when I did rec my benefit they made it retro omitting 5 months. SSI is there ONLY TO ASSIST PEOPLE WHO DID NOT HAVE ENOUGH YEARS IN THE COUFFERS TO COLLECT SSD AND FOR PEOPLE WHO ARE W/OUT ANY SOURCE OF INCOME AWAITING THE SOCIAL SECURITY OFFICE TO APPROVE THEIR DISABILITY. I REC'D DISABILITY FOR LUPUS AND OTHER RELATED DISORDERS NOT FOR THE RP. I GUESS U ARE SAYING WE HAVEN'T HEARD FROM U IN AWHILE AND BOY U DON'T KNOW HOW TO SHUT UP. LOL LOL. Who said life would be easy...I'm actually feeling pretty human, am going into work this a.m. for the first time in 5 months. Hopefully will be able to regroup and go part at least part time starting on Monday. I'm suppose to be a mortgage broker and managing an office. Need to talk with the big boss this morning and see what his plan is. Whole office needs to be redone. Also, going to stop and hair cut...look pretty shaggy. I do work soley on commission but dammit my boss doesn't see things the way I feel he should. Mortgage brokers are a dime a dozen as are Realtors so I could go anywhere. He pissed me off on friday telling me to lose my Money Store mentality. Hell the Money Store was the biggest mortgage company in the US a few years ago. Plus I was closing 20+ loans a month. However, you're getting closer and yeah, it does screw up your credit while you don't have any income- but hang in there. Many of us have gone thru the process, and some have had to file bankruptcy, etc. You do what you have to do. I know that it's no one's first choice--- so keep talking with your creditors and working with them. That way if you keep on track and let them know what's up-- they wil generally work with you. There are also agencies like Consumer Credit Counselling that are free- and they will work with your creditors to get interest stopped, colleciton calls stopped, etc. Your employer is hoping that you will give up. They all do that. However, your attorney should be working with them also- and letting them know that your disability is near approval. If the employer still fights you in regards to LTD or insurance or whatever-- after you've been awarded SSDI--let your attorney fight them. You'll win-- they just truly hope your sick enough to not follow thru. I fought Worker's Compensation for 17 yrs-- and I finally won a payout amount that at least made the down payment on my home. They also had to pay up the medical bills that they had refused to cover because they thought I was faking it. (They knew I wasn't, but they were hoping that if they disrupted my medical payments that my providers would give up on me. I just had the providers file "green liens" so that when we settled, the work comp had to pay up the med bills also.) Also, they knew we'd sue outside the system if they disrupted my care-- as I'd be wheelchair bound if they had succeeded. As for my none-work related illness (sarcoidosis) that had to go thru SSDI, short and long-term disability policies, and it was the employer (SBC) that wanted to fight it-- but once my SSDI approved, and they'd already fought givng me the short-term coverage-- the day SSDI approved, was the day my STD approved, and so instead of spending more of their money on trying to prove that I wasn't sick-- the figured that they may as well approve my LTD also. One of the most important things I can say about SSDI and SSI-- MAKE SURE YOU FOLLOW THE APPEALS TIMELINES. DO NOT MISS THE DATES TO APPEAL. IF YOU DO- THEN YOU HAVE TO START OVER-- WITH A NEW START DATE. YOU LOSE THAT RETRO-ACTIVE PAYMENTS-- AND YOU CAN'T AFFORD TO LOSE OUT. NO ONE CAN. Do hang in there-- no giving up. (Tracie, I had once commented to my attorney that "we would sue if they did ........" whatever it was they were particularly doing in my case. My attorney replied, "the ERISA laws prohibit us from taking legal action against them"; and that "all we can ever get is what they are originally liable for"; i.e., there are never any punitive damages or any payouts other than the original % of salary. I was under the complete impression that the Ins. Co.'s deny everyone (unless the employee is terminal, that is) ... based on my attorney's comment ... what do they have to lose if ERISA protects them? ... they count on the employee not bothering with getting an attorney; if one keeps fighting, they eventually give in I am guessing, which I hope I am right(?)... but again, even if a case goes to trial, they are only liable for what they would have originally paid if they had approved you from day 1.) Guest guest Posted September 19, 2006 Report Share Posted September 19, 2006 Remember that things get different when you're talking Work Comp (on the job injury) vs. Illness. If you are cut off from medical care because your insurance won't cover the expense- and you suffer ie. paralysis because you can't get the care-- you have malpractice. I have yet to meet an MD that refused treatment because my insurance wasn't going to cover-- once I started into this illness- they may have decided not to give me the Remicade, but they at least treated me. (Plaquenil, Methotrexate, Imuran, etc.) My permanent disability wasn't part of the work comp issue- it was caused by NS. so that was a whole different ballgame.
