the "organic law" of the United States. The Declaration stakes our

claim to freedom on the Laws of Nature and of Nature's God, a

What

is freedom?

Freedom

can be defined both by how you can

interact with others and what you can do

with your own body and property. We call

conduct the law will protect - or allow -

"rights." Rights ultimately come from the

prohibitions of moral rules. Because moral

choices are binary - right or wrong -

there is only one unique set of rules that

can maximize freedom, prosperity,

happiness, and peace. This is the

Judeo-Christian set of rules on which

America is founded. Freedom is the

condition that exists when man's laws

conform to God's laws. Show me a nation

based on God's laws and I will show you

the most free and prosperous nation in the

world.

France Outlaws Evangelism

France

has passed an Anti-Cult law that makes it a crime to share

your religious beliefs with somebody else, calling this

The new

law also criminalizes many traditional Christian practices

such as prayer services, fasting and Sunday School. French

secret police are now attending and monitoring Protestant

Christian worship services and many pastors believe it is

only a matter of time before they are jailed.

Europe is

becoming increasingly anti-Christian. One house of the

Swedish legislature has passed a law making it illegal to

say anything negative about "alternative lifestyles" -

meaning preachers who simply quote the Bible's prohibitions

on bestiality, pedophilia, or homosexuality will be subject

to presecution.

Why is

this happening? Because law always reflects what a majority

of citizens believe is right or wrong. As fewer Europeans

have a relationship with God through Jesus and the Bible

they are less likely to agree with the Bible's moral rules.

Why is

this important to us as military folks? Because the U.S. is

explicitly founded on the moral rules of the Bible - this is

what we swear to protect when we take our oaths of office.

The prohibitions of God's moral rules - like don't kill and

don't steal - create our rights - like the right to life and

to property. If citizens don't want to follow these rules,

we could wind up defending the "right" to kill some peopel -

as Nazi soldiers did - or the right to steal - as soldiers

of communist countries do.

Supreme Court Abandons Constitution: Decides by Public

Opinion

In Atkins

v. Virginia the Supreme Court decided that executing

mentally retarded defendants - even if they are competent to

understand the nature and consequences of their actions - is

unconstitutional as a "cruel and unusual

punishment."

The

Supreme Court reached this decision not on an historical or

legal analysis of the meaning of the Constitution's Eighth

Amendment - which prohibits cruel and unusual punishment -

but on the grounds that several states had passed laws

prohibiting execution of retarded defendants.

Why should

this worry us? The criminal law serves many functions. It

punishes criminals forcing them to be accountable for their

actions. This forces criminals to bear at least some of the

costs their actions impose on others.

In turn,

this "internalizing" of what economists call "negative

external costs" means the criminal law serves a deterrent

function. It forces would-be criminals to consider the costs

they may have to bear if they are caught and

punished.

The

criminal law thus also protects society, either by taking

criminals off the streets or preventing their crimes. Last,

criminal law provides a sense of justice. Victims who have

suffered a loss at least have the comfort of knowing that

the wrong-doer was punished.

Allowing

retarded defendants to escape the consequences of their

actions ignores the purposes of criminal law and abandons

all the benefits the criminal law provides society. States

may not even have the Constitutional power to make laws like

this because these laws violate the Equal Protection clause.

Can you imagine a state making it okay for people with brown

eyes to commit murder? Retarded defendants who understand

the consequences of their actions are no different than any

other defendant. They are not eligible for the insanity

defense because they do understand their actions.

But losing

the benefits of the criminal law is NOT the most worrisome

aspect of the Supreme Court's decision. The Court reached

this decision by looking to see what public opinion is

today, and reversed a decision the Court had reached just a

few years ago in a case on similar facts. The court

determined that several states had passed laws to bar

execution of retarded defendants.

This is

exactly the opposite of what the Court is supposed to do.

Federal judges have life tenure so that they will be

insulated from the passions of public opinion that can

change from day to day. They are supposed to decide

Constitutional questions on the basis of what the men who

wrote that document said, not what some state legislatures

may have recently made law.

Of course,

the decision just shows what CS readers know - that law

always follows what a majority of citizens believe is right

or wrong. Placing the ultimate power to decide in the hands

of a small group - Federal judges with life tenure - extends

the time it takes for popular opinion to become law, but it

cannot guarantee that society's law will stay true to an

absolute set of principles like those in the

Constitution.

Islam is a Criminal Conspiracy under U.S. law

The

Koran, which Muslims believe is "the very words of Allah,"

commands Muslims to make war on non-Muslims and allows

Muslims to kill, enslave, or extort protection money called

"Jizya" from non-Muslims. If you do not believe this, please

As you

might expect, U.S. law outlaws any scheme to kill, enslave,

or extort money from U.S. citizens. Title 18 of the U.S.

Code, section 241 states in relevant part:

If

two or more persons conspire to injure, oppress,

threaten, or intimidate any person in any State,

Territory,Commonwealth, Possession, or District in

the free exercise or enjoyment of any right or

privilege secured to him by the Constitution or

laws of the United States, or because of his having

so exercised the same....

They

shall be fined under this title or imprisoned not

more than ten years, or both; and if death results

from the acts committed in violation of this

section or if such acts include kidnapping or an

attempt to kidnap, aggravated sexual abuse or an

attempt to commit aggravated sexual abuse, or an

attempt to kill, they shall be fined under this

title or imprisoned for any term of years or for

life, or both, or may be sentenced to

death.

The rights

to life, liberty, and property are all guaranteed by the

Constitution and U.S. law. Thus, the teachings of Koran

serve to make Islam an illegal criminal conspiracy under

U.S. law. Now, are we going to do something about

that?

Under U.S.

Supreme Court precedent, e.g. Employment

Div., Ore. Dept. of Human Res. v. , 494 U.S. 872

(1990),

the First Amendment's free exercise of religion clause does

not shield religious practices that violate the

law.

Lest we forget

While

most nations and ethnic groups were shocked and

saddened by the September 11 Attack on America,

Palestinian Muslims cheered, and gave credit for

the attacks to Osama bin Laden
