Guest guest Posted May 22, 2001 Report Share Posted May 22, 2001 Hi , I believe the FMLA allows for 12 weeks of job protected leave in a 12 month period. You do not have to use up all 12 weeks at the same time. My advice is this. Take the time you need now, to get yourself back up to par. Let's say you needed 6 weeks... Once you are back on your feet from your accident, go back to work. After a few months, when you are sure any residual effects from the accident have passed, THEN you can consider leaving work again for your surgery. You would still have another 6 weeks of protected leave. Oh, and on the off-chance if you return to work and for whatever reason 12 months pass before you go out for surgery... you would be eligible for another whole 12 weeks of FLMA leave. By all means, if you are up to it, go to your consult. Do all your pre-op tests/consults. Have Dr Vanguri submit for your insurance approval...even schedule a tentative date. But I do agree with Teri's comments >> " You want to make very sure that the pain you are in now is not mitigated by the surgery. If you decided to file a lawsuit against the other driver you may not get a fair settlement. " << If your tentative surgery date is approaching and you aren't feeling 110%, you can always postpone it a few months. Just a suggestion.
