cut and pasted people's words without permission

Dear Kate: please contact me privately if I can help track where and who is

taking from this list without permission and posting elsewhere without

permission. That is just a basic courtesy to ask first. People ask me all the

time, and most times I say yes with certain caveats sometimes.

Just a note about such matters; The Feds Supreme Court handed down a decision

about six years ago that involved a person quoting from another person's

letters without their permission, even though the letters were written TO

that person who then quoted from them. The High Court said the letter

writer's words belong ONLY to the person who wrote them, and NOT to the

individual coming across them or even being targeted to receive them. The

court wrote that an individual's words are covered by copyright even when

formal copyright has not yet been filed, there only needs to be 'intent to

file.' There are many pages in the court papers about the letter writer's

right to sue for breach of copyright et al, but I think the first part is

certainly and definitely cautionary.

I am sorry that has happened to you Kate, (dang, do they know you and your DH

are expert marksmen? Yikes!) and for whomever is lurking, our e-mail addys

always accompany everyone's responses online, and so it is easy to ask

permission first. I do myself write people if I would like to repeat

something they said. It is only basic regard for others, and a regard for

genealogy, for how ideas unfold.

This is just my two cent's worth for anyone who has used cut and pastes of

others outpourings from their hearts from our list, (and without asking

first)--quit it unless you have an understanding with that other person.

Perhaps you are innocent and have done it without realizing, in which case

you are forgiven. Don't do it that way again. However, if you have more dark

motives in mind, also QUIT. If you need to make an argument for whatever your

own opinion is, don't boil someone else's bones to make your soup.
