Guest guest Posted January 8, 2005 Report Share Posted January 8, 2005 Hi everyone! I received a letter yesterday summoning me to jury duty for 2 weeks! Has this ever happened to any of you? I'm a mom of 4, and I home-school my oldest daughter, take care of Maddie 24/7 (she has 10 hrs. of home-based school/therapy a week provided by the public school system), try to keep the 3 year old out of trouble and breastfeed my son all in a days work. There is no-one to watch (or teach or feed!) the kiddo's. Maybe for 2 hours, but not for 2 weeks! Has anyone ever been exempt from jury duty for being a primary care-giver? I live in NM, and I can't seem to find any laws about it. I'm writing a letter to the judge this week to try to explain our situation. Thanks in advance if anyone has any advice. Being a caregiver to a sick family member is one of them...and while it was a mens magazine and didn't mention breast feeding, I would imagine that would also make you exempt. They usually don't give you much time to get in all your info...and at first they denied an exemption (even though I wrote a letter as well). I was able to get my 8 year old son's PCP to write a letter saying that I was his primary caregiver, that he had a serious medical condition, etc. As soon as they got the doctor's letter...I was able to get out of it. I was also pretty upset about the prospect of 2 weeks (and that is if you don't get picked for a jury) as my son was only in school for three half days/per week and I have minimal childcare beyond that. They shouldn't require you to be in court when you need to care for the kids. They would need to pay for the care of your kids while you were in court, and it would cost them a bundle, so it would be well worth it for them to NOT use you. The first time, my son was an infant, and I wrote a letter saying that I was breastfeeding. The second time was when the girls were about 13. I wrote a letter to the judge explaining that they are both severely disabled and that I am their primary caregiver. I wrote a letter and sent it along with Elijah's Doctors note and was excused. Good Luck. Guest guest Posted January 9, 2005 Report Share Posted January 9, 2005 Holly: You are doing the right thing. When I was pregnant with my first child I had gestional diabetes. I just explained in a letter why I couldn't serve this time and about me needing to take frequent breaks and having to eat more often because of that. I was waived from Jury duty. I'm sure if you explain in a very good manner of why you can't serve; but would serve another time for a shorter period of time I'm sure you can get off. I believe if you have a doctor to back you up to about taking care of your ill child would be beneficial. I wouldn't mention the fact that you homeschool. That could be a civic lesson for your child on serving as a citizen. Focus more on your nursing duties. That's about all you can do. Keep a copy of your letter for your records. That's about all you can do. Good luck. It takes a few days before the judge can read your letter and respond. But they usually have a wide pool of people to choose from and so by eliminating you won't hurt their chances of finding some one to serve. If the judge denies it; usually there is a process of coming in and the attornies need to interivew potential jury members and will waive who they feel would not benefit their client.
