I'm not sure if this will help or not, but here goes... I spoke w/ my PCP about Carelink's exclusion to any type of obesity surgery, and he informed me of a recent case. Carelink denied (3 times) a woman in our area who was over 600 lbs, w/ all of the co-morb's including diabetes. She finally took them to court and won. I would be happy to find out what attorney she used, if this would help you. She had her surgery (an rny, don't know if it was open or lap) with Dr. Dan Stickler in So. ton.
