Dear Colleagues,

In case you have not heard, there was a major ICE raid in Portland day

before yesterday. The email immediately below from Alberto Moreno in

Portland, OR is a moving reminder of the collateral damage when ICE raids

pick up parents and leave children unattended.

Scrolling down is a request from Tina Castanares for info that had been

distributed about a year ago on how to anticipate and prepare for such an

event in your community or health center.

Scrolling down even further is the info that of Farmworker

Justice provided to us all about a year ago, with guidance for community and

migrant health centers on how to begin to prepare for such action. Posting

of signs in the waiting room stating that it is for patients only makes your

waiting room a private space, not a public one, thus prohibiting access by

ICE.

There was a raid here iin Portland. About 170 people were taken into custody

at the Del Monte plant in North Portland. This of course has torn families

apart and left children without parents. We also heard from school

principals who called to tell us that children had not been picked up by

their parents and asked what they should do with these children We

organized a community meeting for affected families in St.

s church and offered legal support as well as a workshop on what to do

if they ICE agents came to their homes. We canvassed housing coplexes to try

to reach those children who might have been home alone but know that there

were children whom we did not reach.

We know that they are not done and advocates have set out to prepare other

communities which may be targeted.

I'm trying to find a resource that appeared some years ago, advising

community and migrant health centers how to act and react if the immigration

authorities come around the clinic, parking lot, etc. or try to enter a

health center with a warrant, as had happened once back when this advice was

issued.

Do you recall anything like that?

Or, in any case, can you provide any resources for my health center and

others? (Bobbi, as Alberto knows about far better than I, a terrible

workplace ICE raid occurred in Portland night before last.)

I consulted with some immigration attorneys and got the following advice:

1. Health centers have no affirmative obligation to report a patient's

immigration status to Immigration and Customs Enforcement(ICE).

2. Health centers receive information from patients, including at times

about their immigration status, in confidence. Like other confidential

information, they can only disclose it to ICE 1) with the patient's consent

or 2) if ICE has a court order/warrant. Thus for the most part, the health

center should refuse requests for immigration information.

3. ICE is permitted to go in commercial spaces that are freely open to the

public. Thus, it might help if the clinic posts a sign saying that its

waiting area is only open to patients and those accompanying patients. This

should keep ICE out of the waiting area.

4. Patient treatment areas are clearly not open to the public so ICE can

definitely be excluded from these spaces.

5. The parking lot is a public space. If this is an issue, the clinic might

try to negotiate with ICE to keep them out because it is in the interests of

the public health of the nation that patients have access to clinics - and

they won't use these services if ICE is present.
