I can think of a theory to use to pursue it, but I can't tell you it

would work, since obviously, you aren't " the employee " and the Americans

with Disabilities Act applies to " employees. " But you are an intended

" third-party beneficiary " of the contract between the employer and

employee, and the effect is the same. It's one of those issues someone

will just have to try and see if it gets anywhere. It's the kind of

thing that makes law interesting once in awhile.
