Guest guest
, My first application for SSDI began last year. Although I have fully documented chronic calicific pancreatitis with pseudocysts, pancreas burn out, malabsorption and type 1 diabetes with hyperglycemia and hypoglycemia, osteopenia and had diabetic ketoacidosis and have been unable to work for nearly three years, I was denied the first time. I appealed the first denial six months ago and just today received notice that I have been denied the second time, much to my great disappointment. The denial stated that their findings showed that I was unable to maintain employment in any of the fields I have been peviously trained and employed in because they involved complex tasks and precise skills. Yet they said that while I had many limitations preventing me to perform in a stressful environment, they felt I could still perform " some other work at a slower pace involving only simple tasks " . I have yet to figure out what work this could be, since I cannot stand or sit for any length of time more than 30-60 minutes, cannot lift, bend or move objects over my head, have difficulty with concentration and memory, require 1-2 hour naps each day when well, need several days in bed when I'm not, require narcotic medication just to function 24/7 and have a record of week long hospitalizations at least twice a year since I got CP. I'm tempted to ask them to send me a list of the available jobs involving " only simple tasks " in my area that would hire me with these limitations. I'm 52 years old, and worked part time through high school and college, then full time for the following 30 years, paying my taxes and toward social security every day....so after that long a record I feel devastated to find out that after all that I put in, when I end up diabled from these diseases, I'm denied any assistance. Now I'm paying more out of my own pocket for the monthly pharmacy medications I need than my social security benefits would even pay, so it's not as though I don't have legitimate use for the benefits. I am going appeal and request a hearing before a judge. I found out on this denial that they didn't even review or request my hospitalization records from this past October '03. I believe those records would have had a great influence on my behalf for the second appeal, and I don't know why they weren't included in the review. Sorry to ramble on so, you just asked this question at the wrong time. I'm so angry and disappointed that I could cry for a week. You'll get many different answers to your question, as some have tried and been denied as long as I have, and then finally gotten it in court, while others have gotten their benefits on the first application. There seems to be no rhyme or reason to why it works this way. Good luck with yours, if and when you decide to apply. With hope and prayers, Heidi Heidi H. Griffeth Bluffton, SC SC & SE Regional Rep. Guest guest
I am so sorry to here about the outcome of your SSD application. You are right no consistency exists when it comes to denying or accepting applications. My brother-in-law, for example, has severe diabetes and got his SSD approved on the first time with no problem. Can you hire an attorney? They can help you through the appeal process. You don't have to pay them until you get the back pay from social security. Binder and Binder is one that advertises and their information is on the interne. Their wesbite is www.binderandbinder.com. Their phone number . The phone consultation is free. Guest guest
Heidi, I'll add my prayers that you get a judge who was like the one I got. As soon as he was assigned my case, he took one look at it and then approved it. You certainly have a lot of medical documentation to help you. Just thought I'd say I'm routing for you in getting this. Kimber -- Kimber Vallejo, CA hominid2@...
