Thank you both for your advice and response. I have a letter ready to send

to the owners and management, along with a letter from the doctor. If they

deny our request again, we found a lawyer who deals with this sort of thing

and he said we have grounds to take action. Kelsey wants to walk up the

stairs, and when she tries she makes it half way up the first flight and

can't go any further. We plan to start looking for another place anyway and

if they try to sue us for the remainder of the lease they will have a very

rude awakening. This manager has no concept of the fair housing laws.

Either way, we will do what is best for Kelsey because our girls always come

first.

, Laws are practically different in every state but I believe

there is a federal law prohibiting discrimination to anyone because

of a physical handicap. Seems like I've read that every building has

to be handicap accessible and they have to comply. I just believe

the manager could face stiff penalities and worse. There is an

organization with lawyers to help children with disabilities that the

Arthritis Foundation probably can put you in touch with. I think the

lawyers do this free of charge, too. They are just tickled to pounce

on folks that mistreat children. Your manager is mistreating your

child because she is not allowing her to be her best and for her to

do for herself. Maybe if you point out it would be a whole lot

cheaper for them to allow you to move than it would for them to make

their building comply. Try to contact the building owner and explain

the situation too. If they are not compliant then use the media.

The building owner most likely would not want the negative

publicity. I have two kids with JRA and when they are unable to

function " normally " (for lack of a better word) it effects their

health, mental and physical. You might search on the internet, too,

under rights of physically disabled. Sorry so longwinded. Hope some

call the houseing authority on this and legal aid

you do have rights here

and if that apartment building does want to cause problems take them to court

its called a disability act

you have a paper from the doctor thats on your good side

what state do you live in?

dont let anyone tell you that you cant move

they have to either get you on a 1st floor or they break the lease

they have to have a elevator

due to melissa haveing to use the elevator at school i do know some on the

houseing disability act

We live in Virginia. I've been searching for info and found some answers. I

know you live near or in Atlanta, and ironically enough the owners of this

place are in Atlanta! Its called Just Management, Inc on West Wieuca Rd, NE.

lol My husband and I are frantically looking for another place to live, and

as soon as we find a place we will be moving. I'm pretty sure we will also

be taking legal action. This is the same lady who fired me because I had to

put on bed rest when I was pregnant with Kelsey. She got away with that, but

not this time. She is very crooked, not to mention cold hearted. I'll keep

you all updated on what happens here. It could get very interesting! lol

have you checked the BBB?

i will check this and let you know if this company has property in other

states

well every state may have complaints on this one also you can add a

complaint to this company and state what it is

it is federal law all apartments have to be handicap equipted

We are still looking for a house, and as soon as we find one we are

definitely moving. Kelsey had her appt with her rheumatologist yesterday and

she said we absolutely do need to move, ASAP. She is sending me a letter

along with copies of all her records and notes, including those from PT/OT.

I'm just waiting until we find a place to move, then I will start filing

complaints and seeing a lawyer, if necessary. I'm sure as soon as the

manager gets some legal documents she will be backing off, but if she wants

to sue us for the remainder of our lease, I'm ready for her to take us on!

LOL I've been told by doctors and a lawyer that she can't do this, so its

just a matter of time! Thanks for your help, and for the links. I will be

using them very soon.

you have a copy of your lease? is there any clause in that ?

another thing to do is KEEP ALL reciepts of your move

includeing food storage if any and moveing truck

any expense YOU have to pay also write down the time you start looking

for a place and how many times you have talked to her

make a journal this will help you down the road

make sure you have your doctor papers

even get medications your daughter has to take

i talked with my hubby he said theres no way a apartment complex

can do that legally without a suit

one thing as he says you cant do bad things when it comes to kids and the

elderly

another thing also is to take pictures or video tape the entrance and the

way to your apartment

then video tape the child walking it or take pictures any violations you

see in the apartment also

i am trying to remember what else you can do

my hubby works commerical and homes

he knows about the equiptment for handicap

discrimination is something that complex dont want

exspecially with a child

I'm getting all my paper work together now, including my lease. They don't

have a clause, but I bet after all this is said and done they will have one!

lol What they are trying to do is obviously wrong, not to mention against

the law. I didn't think of video taping Kelsey going up the stairs, or

taking pictures...excellent idea! I will definitely start doing that.

Hi ,

Sorry to hear that you have to deal with this hassle right now. These

things do take a lot of time, energy and perseverence but you're doing

the very best you can for your daughter so I'm sure it will all be

resolved with a positive outcome. Please do keep us updated on the

progress. I hope you find a terrific new place to call home, that will

be safe and comfortable and easily accessible for all members of the

family.

Hey, very well could be. I am going in for an endoscope down my

stomach on Friday, they think I have an Ulcer (but don't test

positive for the bacteria which causes most of them). Over the years

I have consumed massive amounts of ibuproven,arthrotec, celebrex,

aspirin... not taking any of that now..except baby aspirin coated,

and of course vicodin and valium for spasms (oh, and about 10 other

meds, none of which they think causes ulcers). You might check out

Ultram, there is debate (even in this group) whether it is addictive

and narcotic. Don't have any idea if it is a stomach problem or not,

but something worth looking into. Tylenol is proabably the only

other option, celebrex and vioxx are less lethel on your stomach, but

still can cause problems.

By the way folks, diactivated my account for some reason, so I

am back as berry_kris instead of krisb. Wasn't worth figuring out

why !!!

I am so happy you asked this question. I can't answer or help, but I just

started on Lex and was wondering what sexual side effects, if any, that

people have experienced.

Hi Everyone, Ok My problem is I have been on Lex for about 3 months now, and

I have absolutley no desire to have sex or even get close to my bf of 4

years. I was wondering if I should stay on it or try another SSRi but I

really like Lex and it has helped tremendosly with my social anxiety. What

should I do? Thanks

If the med is helping, that's great! I'd recommend staying on it and

giving it a chance.

When I first started on the Lex, I did have a much diminished libido,

but I knew it was a possibility, so I was prepared for it. For a

while I had to MAKE myself be intimate with my husband, whether I was

really in the mood or not. After a time, my libido came back. I

don't know if forcing myself helped, or if this side effect just faded

away on its own, but either way, I'm back to normal.

I'd recommend talking to your doctor about this if it's a concern. I

know a woman who took Lex and Wellbutrin, the Wellbutrin to counteract

the decreased libido...

I'd also recommend talking to your boyfriend about this, if you

haven't already. If you haven't, he may be wondering what's going on,

if he did something, if you're mad at him for some reason, etc. Even

just sharing your concerns with him might lighten your load a bit. :)

Unfortunately, there's no solid yes or no answer to your question. That's why so

many of us feel the need to band because we don't know what the future holds,

and there are too many " what ifs. "

How old is your son? Is he in a helmet now?
