You should get a copy of the regulations in your state, but I know that in NY you can state why you have a problem with their eval. and request that they pay for an outside eval. If they want to say " no " to you they have to go to an impartial (which probably costs more than an eval). You have nothing to loose and you can look for someone who is willing to work with you to get optimal scores for your son. You can also request that the district do a non-verbal IQ test (such as the Leiter) in order to get an IQ score that isn't influenced by his verbal delays.
