If the insurance requires that the patient own it after it is paid for, then that is what happens. All federal and state insurances require this and so do many private insurances. We comply with that requirement. Selling it on ebay is OK if you own the device; the only caution I would give is that it is a prescriptive device that is regulated by the FDA. The individual receiving it must have a valid prescription. Failure by the seller to secure that information would be dispensing a medical device without proper licensure. It would be a violation of federal regulations and the seller could be held liable for any injuries/death to the person who used it improperly and without physician supervision. Plus, the used Vest would not be under lifetime warranty and the support services would not be available. The ONLY reason we offer it as a lifetime lease is so that we can try to avoid situations like this. We don't want it to be used improperly and be used without medical supervision. All the Vests we get back are refurbished and put into our Critical Needs pool. They are used as demonstrators in the clinics and hospitals, and donated to groups like the CF Foundation, the ALS Association, the American Lung Association, etc. We NEVER send a used device to a patient and bill for it. Not only is it unethical, it is illegal. I hope that clears things up. Thanks! Randy RE: Vest on Ebey Oh No.... I did also post when this was first on line & did tell them it was a medical devise & HAD TO HAVE AN Rx for each machine sold. Folks really think of it not as a medical devise. I had another thought also. The equipment is universal as far as it could work for anyone. Shouldn't the vest part also be fitted to an individual? This would insure that the equipment is being used to its full potential. We don't want anyone to be denied access to the Vest, but, more importantly, we want the Vest applied properly and under the supervision of the family's physician and healthcare team. If the insurance company requires ownership of the Vest to go to the patient/family, that is fine with us. They have every right to use it as they see fit. Being in such a litigious society here in the US, I would hate to see somebody have problems because they improperly passed on the device. That is my biggest fear. Fiona is going Trick or Treating? I will tell you that anyone who needs a Vest will get a Vest...regardless of their financial status, insurance status, etc. We have programs in place to insure that. If a family cannot afford it, their insurance denies it, they don't have insurance, etc., we will make it happen. That is a guarantee. Obviously we need to try to get reimbursed where we can so that we can continue to operate as a company, but nobody will be denied access to the Vest. We have approximately 3000 machines out there that we have received no reimbursement for. And we don't expect to. The machines that are returned to us are refurbished and are used in our Critical Needs pool to be used many ways, including providing them to families who cannot afford the device. How can we afford to do this and stay alive as a company? Many of the insurances out there have seen the value of the Vest and the cost savings they have realized; therefore, most approve the Vest. We, as a company, understand our moral and ethical responsibility to the community we serve. We take it VERY seriously. OK, off of my soapbox. I am very passionate about this and as a RN, the patient comes first. I am with a company (Hill-ROM, formerly Advanced Respiratory) who believes in the same. I hope this helps.
