That's Great!! I just got an e-mail from Debbie this

morning that says she is behind a little and Dr. R.

will be reviewing my packet. She said she hopes to

get back with me Friday!!! Whoaa,maybe one more day!

Robbie,

I've had an ongoing battle with BC/BS of Ala. Apparently, their guidelines

require that one be twice ideal weight (as determined from the MetLife

height/weight tables) for at least two years. This is far in excess of the

indications for weight-loss surgery contained in the NIH guidelines, which

merely require a BMI of 40 or greater (or 35 or greater with comorbidities) and

100 lbs above ideal weight (measured by the NIH's tables). So I don't think the

BC/BS guidelines would withstand a lawsuit.

Unfortunately, I'm not in a position to bring a lawsuit at this time, but I

encourage you to do so if you're denied by BC/BS on appeal!
