I was fired from a job b/c I was pregnant with and then my husband was out of work due to carpal tunnel syndrome surgery for 4 months. No job on the horizon either. Anyway, is it possible to have Terri's check on a direct deposit program. Many employers and governement agencies preferr this. That way it doesn't get lost in the mail and the funds are available immediatly on the day of deposit. Plus with on line banking, you can see if the check is there using your computer. Also, I don't know what state you live in but most sates have laws that prohibit a landlord from evicting you because your rent is a few days late. Usually that process takes a few months and you could always appeal. If it ever got that far you could show how you have consistently paid the rent but always a few days late because of the way the banks handle the funds. In addtion, many states give you a 10 day grace period to pay any bill so you have a chance to resolve any disputes about that bill. It might include rent. Last, maybe you could write or call your landlord and explain your problem and ask her if she would change the due date to something more convient for you. You could always threaten to move. Remind her it is far better for her to have a trusted paying tenant than try and find a new one who might not be so reliable. Plus, she is in Florida, your are in ? If she has to evict you, she wil have to make the trip to ? or she will have to hire an attorney. Either way, it will cost her more time and trouble than if she just changed the due day. You and your check book have some leverage over this person. Try and use it to your advantage. I hope this helps. Guest guest Posted September 26, 2005 Report Share Posted September 26, 2005 hey ken!! sorry to hear about the boat you are in as well!! it seams like it never ends, huh!! his check is through workmens comp that is why it is not direct deposited (his regular check when he was working was and i pay all my bills on line pretty much now) she is very hard headed and you cant explain anything to her, i did call her and even wrote a note that i put in with the rent check for this month expalining everything, but she doesnt care!! as far as eviction i think she may have the upper hand because she changed the lease to a monthly lease instead of a yearly so it is easier for her to end it without having to go through eviction. we will figure out something, we always do it just stresses me, we never seam to catch a break (and i know other people have worse things going on) but it seams like when ever we get everything figured out, bam something else comes into play that messes it all up!! jodie c Quote Link to comment Share on other sites More sharing options...

Look at what we are going through with Max. And you know about our finances as well. I just wish I could do something to help you guys out. I don't know what to say other than I'm pulling for you. I do think that Ken is correct, even if you are on a month to month lease. That land " lady " would have to go through some sort of action to get you evicted and it would take time. She cannot just show up and kick you out in a day or two. What she can do, however, is give you notice that she chooses not to renew your lease as of a certain date. But even her making you leave would take time. I sure do hope that you do well with SSI tomorrow and the NJ FamilyCare comes through for you. I would write her a letter and explain when Terry's checks come and that you will gladly put a money order in the mail and have the post office post mark it so that she can see when it is going out. Besides, she can't just kick you out without a court order and there is no way in hell she can get a complaint filed, an answer received by you and get in front of a landlord/tenant judge (special civil/small claims) within 8 days. By the time she files the complaint and the court gets it out to you at least three days go by. Depending on the amount of her suit, you file an answer (special civil part not small claims). If you have the opportunity to file an answer, you get 35 days to file an answer and then its at least a month or two before you get a trial date. If it is a small clams court, and you dont' file an answer, you still don't get a trial date for a month. However, in the interim, if you pay the rent before the trial date, she has to dismiss the complaint, if not you send in a copy of everything to the judge (and I of course will type the motion to have her complaint dismissed) before the trial date. If that doesn't work you go to court and show him that you paid it and your circumstances. Believe me at work we represented a landlord and it took about 6 months. Guest guest Posted September 26, 2005 Report Share Posted September 26, 2005 thanks jennifer!! i will let you know if i need your help with it!! terry is going to call workmens comp to see if we can get his check sent early so we have the money in time. after this month we will be able to do it because i will be prepared to pay it that way!! the hard part is we are just paying sept this week and now we have to follow it right up with oct. no offense to anyone but she is an 80 something hungarian women who is very hard headed, can barely understand her, and you cant explain anything to her at all!! we have been here for 8yrs and the last 2 yrs we have had problems off and on because of different things (terry's demotion for one). what she doesnt realize is if she doesnt resign our lease she is going to have to put big time money into this dump before she can rent it out again!! and i will then call the health dept about the mold in the basement (now i know you are all thinking, why do you stay there, the rent is cheap for our area and we were hoping to be able to buy our own house by next year!!) enough of my problems for now!! thanks again!! I read all post but only answer when i think i can help. I also am on Workers Comp and have been for 6 years and found out last week i will be for Life. 4 failed Major Back Surgeries. We have Direct Deposit here and they were more than happy to do it that way for me. I think it is great. I don't know where you live but i have studied the laws of Workers Comp inside and out and even have the laws from the ND century code. If not it may be a month to month lease, however, the two of you are bound under the terms of the lease you were following. But again, even if it is a month to month lease - unless she gets a court order evicting you - you are not evicted. New Jersey's laws are really geared to the tenant. It may not seem that way but talk to a landlord and you'll know. Call me I have a classic landlord story. The tenant tried seducing my boss in front of me at our office - it was hysterical.
