It even includes morbid obesity in the wording which is what usually wins an appeal - MORBID obesity is very different from just obesity. Did the agent put the " included if medically necessary " statement in writing to you? If not, it might be a case of " he said she said " . The company I worked for insures insurance agents for errors and omissions. I saw these kinds of claims all of the time. Sometimes we would just settle and other times we would fight so I can't say what your chances would be should you put in a claim with your agent's insurance company. I would write to him (Not call!) and state that 3 times he said WLS was covered if medically necessary and now you've reviewed the policy and can't find the wording. Ask him to point it out and remind him how he was helping you to find a policy that allowed WLS and that's why you went for this one. Please be polite and non-conventational - there's always time for that later! You might also send it certified, signature required to make sure he receives it. Good luck and please keep us updated. Maybe you can add a rider or just go to another company/agent.
