He will get approve because your income don't apply,only his if any.If he dont work still he'll get $$$ and medicaid. He will go through the hassel of not getting approve but always appeal and when he gets approve he'll get all the $$$ from the first time he applied. I heard SSI but its very hard to get on so some try medicaid or medicare I always get them confused. If he is a student couldn't he stay on your insurance? Try checking with your local Dept. of Health I believe that would be their jurisdication. Also, try State Dept. of Insurance. Rosemary in NY with 3 children (13, 11 and 7) with CF. It is very inexpensive to form an LLC (here in CO it's $50) and thanks to the laws passed by Clinton (which include HIPAA), insurance companies MUST offer group coverage to any company with at least 2 owners, partners, etc. Here in CO you only need 1 person, so check your state law. Group coverage means no pre-existing conditions. Also, the insurance company must offer you the base rate for the first year- they can raise the rates obscenely every year after that, but you can switch from group coverage to group coverage each year thereafter or until he finds a job that offers medical coverage. Another option is that if he cannot work full-time- perhaps his treatments or condition would preclude him from holding a full-time job- the federal law also allows you to get a statement that he is " unable to hold full-time employment. " I'm unsure of the exact terminology. But in a nutshell, that would allow you to keep him on your insurance indefinitely, regardless of his age or student status. She is the one who does the article in the ROUNDTABLE newsletter. Beth has CF herself ( & her sister also.).She & her husband both are attorneys.. He is in Federal law & she does workers insurance. Some states, like CO, for example, have even better laws- the one person company that I mentioned. I believe CA is the same way. But the very " worst " it could be would be a 2 person company. A little different since it is my ex-husband that has told me that he is removing him from his insurance after his 18th b-day(in 6 weeks). Guest guest Posted January 13, 2004 Report Share Posted January 13, 2004 Oh, gosh... That's a shame that your insurance will soon max out. What's the cap? Is it $1,000,000? Many companies have been raising the cap to $2,000,000, though the university I used to work for held their cap at $1,000,000 per person. We've been in tricky situations too, but never the maxed out problem. My son was covered all through college, even when I went on COBRA insurance after moving to Chicago in August 2001. My COBRA was due to end March 1, 2003, no big deal because I was beginning a new job and it was way cheaper for me to drop COBRA and go with my new employer. But that wouldn't help my son because he was over age 21, and the Blue Cross/Blue Shield plan with my new employer only covered college students through age 21 (jerks). He graduated college in December 24, 2002, so theoretically he wouldn't have been eligible to continue on my COBRA from January - March 2003. Believe me, I was starting to panic; however, Beth Sufian (God bless her!) told me that because he was OVER age of 21 AND no longer a full time student, then he was eligible to continue COBRA under his own name for an additional three more years. So that's what we did -- put him with my former employer on the COBRA plan. He carried COBRA from Jan. 2003 to August 2003, when he went full time with his employer and got on his own group plan. If your son is 18 and able to go to school full time, then he should be able to stay on your plan. I know you know this, the issue seems to be that your insurance on him will soon max out, so expenses won't be covered anymore. That's just unbelievably sucky. (My vocabulary skills are in fine form today, aren't they?) Do give Beth Sufian a call... she's incredibly good at what she does, and she'll give you some options. I've met her in person at CFRI conferences but I wasn't quite sure she remembered me until we spoke on the phone about this same time last year. Guest guest Posted January 13, 2004 Report Share Posted January 13, 2004 In my state it considers the child, if medically needy, as a " household of one, " and therefore the child has the possibility of getting Medicaid and/or SSI as a child and/or Medicare if the child has a parent who is deceased, or in some cases, a working parent, and a low income.
