Wiping down of desks with antiseptic wipes. Being excused from physical activity during heat waves due to the possibility of dehydration. Allowing water, beverages and snacks to be consumed at his desk. If extra breathing treatments are to be done during school hours, breaks should be provided for this. Some have requested air conditioning in the classroom if it is not already available. A tutor should be provided, should he be hospitalized or at home with an infection that keeps him out for a week or more. Sometimes access to enzymes can be a problem with some schools, so allowing him to keep enzymes with him and self-administer them is often included. Also, if he requires other types of meds, like prilosec or other antacids, or any other kinds of medications, that can be included as well. Guest guest Posted February 6, 2004 Report Share Posted February 6, 2004 Help!!Adam is in 2nd grade and we just dismissed him from special education ( speech and voice therapy). Until today all the cf requirements (extra snacks,drinks,rest,etc) were included under the special ed. The plan was to place Adam under a 504 so the cf requirements would be enforceable, but the school refused. Adam doesn't represent an educational need for a 504. He doesn't qualify for the OHI (other health impairment) under special education because cf is not causing an educational need.The school saids they will follow the guidelines set by the drs, but we would like a legal leg. Any suggestions? Does someone know the email of the attorney in Houston who helps with cf? Guest guest Posted February 6, 2004 Report Share Posted February 6, 2004 Hi , There seems to be a lot of confusion about public school services. In your case, if Adam attends a public school (any institution receiving federal funds) then he qualifies for a 504 or " other health impaired " (OHI) plan because of CF. But just because he has CF, doesn't mean he also needs or qualifies for an Individualized Educational Plan (IEP). Private or religious schools may be exempt from these government guidelines, unless they also receive federal funding. People confuse IEP, OHI, and 504, lumping together in the same egg basket. An IEP is exactly what it says: individualized instruction for any student who has been tested and found to have any LEARNING DISABILITIES. Period, end of definition. Keep in mind that the learning disability *might* come from a health impairment that causes a problem with speech, vision, hearing, cognition, or motor skills. An example of this might be Down's Syndrome or Cerebral Palsy. In this case, the student might have both an OHI and an IEP. CF, on the other hand, affects " one or more life functions " as defined by the Americans with Disabilities Act (ADA). It's this ADA definition that qualifies and entitles students with health impairments under Section 504 the Rehab Act of 1973 (hence the nickname, 504 Plan). (Even though historically, the ADA was passed many years after the Rehab Act of 1973). A student with CF or any other health impairment (such as asthma, diabetes, epilepsy, cancer, etc.) qualifies for an OHI. It is NOT up to the school to determine the severity of the impairment. The school cannot deny the right to have an OHI in place simply because they think a child is too healthy (my son's elementary school nurse tried to pull this, saying he was too healthy, but in only one sentence from me, she changed her mind on a dime, while his third grade teacher and school counselor looked on with complete agreement and smug satisfaction. I hope this clears it up. Go back and rattle some cages if you need to.
