The lawyer takes his commission from the backpay that is awarded. Social security automatically deducts the amount and sends it to the attorney. However, sort of good news, he's allowed to take 25% OR a maximum of $5400.00, whichever is LESS. I only got about $5900 for my backpay and they only took out about $1300 (I don't remember the exact amount of backpay and amount they took out of mine, but these are close estimates).
