Is the school required to make up IEP sessions? (NJ)

My son has recently started Preschool disabled schooling through the district.

He is scheduled for 3x/week sessions, and he is in his 10th week there (29

sessions as of today). The SLP has recorded him taking only 14 sessions.

Of the 15 sessions he's missed, the breakdown is:

4-5 to be my fault (at least 3 sicks and 1 appt)

3 to be snow days

6 from the teacher (2 weeks straight - possibly her vacation?)

1 trip to the nurse (today)

Is the school required to make these sessions up? He seems to miss more speech

than he gets. I assume that I'm not entitled to the days that I didn't send him

in, but what about the rest of them? I would've thought that if the teacher was

out (especially for 2 weeks) that those sessions should be made up.

I wrote the SLP a note and am awaiting her response, and will contact the Child

Study Team on Friday if I don't have an answer. In the meantime, any advice

would be great.

I would love to know the answer to this one!  I am sort of in the same boat ...

not quite that bad, but I dont want ANY sessions to be missed.

not sure about your district but in our district the rule is, if a session is

missed because the school is closed for whatever reason or the child is out sick

or misses due to an appointment they do not have to make it up but if it's

missed because the therapist is out then they do have to make it up. I would

check with your school and find out.

I think they should attempt to make them up within reason. I doubt they are

required to make up snow days- remember that would involve every child who had a

missed session in the whole school--not just speech- but also OT PT and Play

therapy. I looked on the IEP website and found some legal jargon which was

discussing ESY--but did mention missed sessions during the school year. They

should have provided a substitute if they knew the SLP would be out. But we all

know how hard it is to find an SLP when you need one! I dont think they are

required to make up ones that he was out of school for either. You are in CPSE--

and these are IEP rules and guidelines- but hopefully they will fit in what they

can before the year is out. If one SLP was out- that also affects all the

students that he/she was there to provide services for.

I would also emphasize that they are

bound to

It is my understanding that ones that are the school's fault they are

required to make up. So teacher vacation and illnesses need to be

made up. This is how it worked for us when my son was in preschool the

one year where I took him to the school for speech therapy. If he was

sick and missed then he just missed. If the teacher was out we got a

make-up session.

When it was due to them not implementing his IEP for MONTHS they said

they didn't have the staff to provide make-up therapies, but they did

reimburse me for my cost after insurance for his private therapy we

had done during that time period. This was all after a BIG fight.
