I asked them why you want to change the services they said your daughter needs intensive therapy and this is what we offer now. I actually disagree with them, and said I will not do this , means STAY PUT on the old IEP, which says 20m/3 times individuel , 25m/group and one hour private, as she had done an ear surgery last year, also english is my second language. Now we cant understand what is going on, and we are worry about STAY PUT, is there any risk, also we asked them for this, the school SLP said NO , I will work on the old goals, and I might see her The same amount of time. NOW what we can do, why they did this with us, we only feel that our daughter need some services, as we watched some bad behaivours in home, eating papers, so we asked about the full assessement. PLEASE TELL DID I DO SOMETHING WRONG?????? OR NOT ILLEAGAL. WHY THIS IS HAPPENING< if they dont want to add services, why they change the placement and services, also she achieved her goals in this envirnoment. Guest guest Posted May 20, 2009 Report Share Posted May 20, 2009 I want to correct what Lori stated. Legal Aid is not entirely free;they charge a fee, then they determine if you are eligible. Then it is anyone's guess if your state handles special needs cases thru legal aid (doubtful...at least in GA). I have found NO PRO BONO attorneys NOR free advocates. Guest guest Posted May 21, 2009 Report Share Posted May 21, 2009 , Actually you are incorrect. You need to be screen for financial eligibility FIRST, then by the type of legal case you have. They do not charge a fee if you cannot afford it. Legal aid uses the Federal poverty guidelines (125% below poverty level) to determine eligibility for services and so if you fall in that category, it is FREE. In some cases, for those in low income, a sliding scale is used and a small fee is incurred based on income if you fall in that category. In my state, the website indicates that " Civil legal aid in Ohio refers to the free legal services provided by hundreds of attorneys and paralegals throughout the state. " I checked out your state's legal aid society and it states that " Georgia Legal Services Program is a law firm which serves people with low incomes. The Program provides free legal assistance to Georgians who live outside the five county metro Atlanta area. " Sounds like free is free to me. Legal aid offices do accept educational cases, I have worked with many legal aid attorneys and it is also stated in your state's website. (http://www.glsp.org/RTF1.cfm?pagename=FAQs_Temp) There are non profit organizations that have parent advocates that assist parents in IEP meetings, again at no cost if they are low income. I am not familiar with your state so I do not know which and how many of these non profit agencies exist in your state. I am aware there are individuals who charge fees, but I am not talking about them. If you have been unable to receive free legal aid from the local or county legal aid office near you, then it may be because of your income. If you have been unable to find a parent advocate, that could be there isn't a non profit agency located near where you live. Doesn't mean that it holds true for everyone else in this country or on this list. Based on the information Caroline had shared on this group earlier, I had presumed she fell in the low income group and therefore suggested legal aid or a parent advocate, and, given that she lives in California, she would have a pretty good chance of finding such services.
