He's receiving special ed services, and there's never been any question about it. We are in Pennsylvania. We have been consulting with a lawyer all year long, and she told us that once he starts 9th grade, they cannot put him back in the middle school; that he will legally be a freshman then and there's no going back. Is your son starting at a charter school or regular public setting? I think that is the difference here. Charter school sometimes have their own governances. P.S. The school is in district but is a smaller high school not the regular high school this one is set-up as a self -paced smaller classrooms the classrooms have about 15 kids per teacher which is one of the reasons we want him at this location. Most kids have to go thru an application process to be admitted at this location but because of my sons special circumstances he did not have to go thru that. His ARD committee presented this to us as one of our options. We felt this would be much better than the regular high school which probably has in excess of 800 kids and the one we chose has about 75 kids > > Okay I really need help.
