Did you try you local Protection and Advocacy group???

Also you may try your parent group through the state. I'll try and find

the info for SC.....

Need some legal help

Hi All. If anyone knows of a good attorney in or around the state of

South Carolins for an education problem. Please e-mail me off list at

We are having some major problems and need some advice.

You could see if there is a legal referral service in your area. Maybe google

it or try the local court house. If the reason for the taking custody is

directly related to the aspergers maybe someone with the local autism society

can help.

who specializes in special needs kids.

Crystal, I am in Canada so the information will not reflect the same laws in the

US, but it may be important to point out that similar deficits in the system

exist: If, like someone pointed out, your case is related to the Ministry

stepping in because your child has Aspergers, it is not acceptable!

In Alberta, Canada, I was able to effect change to laws which archaicly viewed

individuals with developmental differences and medical needs; tragically grouped

them amongst children requiring protective services.

Cite the Legislation (here, too, is the link) of Amendment. Surely laws may be

transferable... At least, fought with basis if there are cases of prescedence

such as ours:

As a Canadian, I am able to offer perspective supportive of tragic events which

occur and sadly, I have learned from near and far, these deficits transcend

boundaries Nationwide.

Particularly, my Advocacy is aimed at the prevention of families of Children

with Disabilities from being grouped amongst individuals who may require

protection. No clear division exists in many instances and this has created a

large chasm of unnecessary separation of families.

In effort to access Government services and funding for loved ones with medical

and developmental needs, natural, loving families have been faced with

unconscionable 'choice' which includes surrendering guardianship and out of home

foster placement in order to achieve help.

The victimization that has arisen when well-meaning entities wield power

ineffectively and without adequate contemplation of the results that follow

interference has been atrocious. Fortunately, I was able to effect an Amendment

in Legislation in the Province of Alberta.

Family Support for Children with Disabilities Act (FSCD) of Alberta, Canada

Section 2-3, Manual Amendments: Policy and Procedures in Family Centred Supports

and Services, Effective December 2006.

The Family Support for Children with Disabilities Program to have separate

legislation from that of child protection services.

I encourage others to take action on this particular stance to preserve families

of children with disabilities intact. Family-centred Care must be prioritized

and solidified by review of current Policy which is often archaic and

counter-productive in its vision towards individuals with disability. If we are

able to salvage the lives and core values of families who are already facing

tremendous strain with the diagnosis of developmental disability - and/or

medical issues - we offer this model to others whole-heartedly in celebration of

the life of our beautiful little girl.

By the way, if there is a Child Advocate Office connected to the DCF, get them

involved. The Advocate is there to look at the best interest of the CHILD and

generally will serve the role well.

Sadly, lawyers are quite pricey! And, regards to legal assistance, the cut-off

in income is very sparse. It is available for only very low income earners which

makes middle class folks unable to access help at all!
