My swelling went away completely around the 2 week mark. As far as your symptoms now, I would err on the side that your instincts tell you ... that you disagree with your doctor's conclusion that " everything is fine. " I do not know what may be available to you as far as follow-up, but if you are devloping an infection or other conditions such as you describe, it seems more than reasonable that you insist on a thorough evaluation so you can get to the root of your problem soon. Do they recognize his disability?Golly.....I'm trying to think what I'd do in this situation. I don't have an advocate...so I'd call my states' Autism Society as well as the countys' Social Services. I do not consider a psychiatrist or therapist worth working with if they are not willing at least to write a letter. If you don't have a psychiatrist, find a pediatric psychiatrist that is willing to write an evaluation that states he has AS or anxiety or dysthemia some diagnosis and have the doctor specify that he needs a supportive setting to shape approproiate behaviors. Make sure that you ask if the psychiatrist will write an evaluation if not move on to the next docotor. Stay away from forensic psychiaatrists/therapists they are appointed sometimes by courts and often (not always) are not very sympathetic. He can't make a threat against them if he isn't there. That would also make them hurt for money and maybe you can get your doctor or psych to write a letter to them saying what kind of damage they have done to your son with all this, is he aware of their threats?? Basically the teacher sends home a bunch of homework that she had planned for the class and he has those 30 days to finish it. I wouldn't want him at school during this time either. Then can misinterpret all sorts of things, or provoke him etc. Also I don't think he should be made to feel that he did something so awful. The weight of the world is on his shoulders right now. Yes he could try to control what words come out of his mouth but it is part of his disorder. Which brings up a point. If he has an IEP and they are aware of his disorder then this could be proven that it was a manisfestation of his disorder. Definately need to call up some help - an advocate or a disability lawyer... someone. Maybe in desperate measures to bring negative attention to the school you could call the news channel ????? just a thought but probably only if you don't plan to return to that school. sorry, I'm probably not much help as I'd like to be. ANY time they suspend or expell a child with a disability for more than 10 days they HAVE to conduct a manifestation hearing. Any change in the placement from the placement of his IEP requires an IEP meeting unless you agree to the change in placement. If at the manifestation hearing it is determined that the behavior is part of his disability (which it should be) then he stays put. Below from the book "All about IEPs" ... You should write a letter to the director of special education for your distric and copy the principle, and the head of your child's IEP team. Describe the incident that led to the arrest. Request a functional behavior assesment (FBA). Request an IEP meeting to review the FBA. Then request a behavior plan be developed to help address your son's inability to express his frustrations in appropriate ways. They are required to do this.... SEE BELOW FROM IDEA 2004 SECTION 1415 (k) On the date on which the decision is made to make a removal that constitutes a change of placement of a child with a disability because of a violation of a code of student conduct, the LEA must notify the parents of that decision, and provide the parents the procedural safeguards notice described in 34 CFR 300.504.[34 CFR 300.530(h)] [20 U.S.C. 1415(k)(1)(H)]7. Establish a new standard for manifestation determinations.Within ten school days of any decision to change the placement of a child with a disability because of a violation of a code of student conduct, the LEA, the parent, and relevant members of the child’s IEP Team (as determined by the parent and the LEA) must review all relevant information in the student’s file, including the child’s IEP, any teacher observations, and any relevant information provided by the parents to determine: If the conduct in question was caused by, or had a direct and substantial relationship to, the child’s disability; or If the conduct in question was the direct result of the LEA’s failure to implement the IEP. I took off work yesterday and had found this on the Internet under laws and ARDS (heard later they were supposed to give me a copy) I called and ask for an emergency ARD and have a staff meeting instead at 9:00 this morning to Start Fresh (per director of special services) She told our social skills director, that was holding a copy of the write up and letter talking of the arrest that would happen upon another incident... By the way that was our first write up!;(I had mentioned to the principal that was our first write up and he said they are bringing more in! That there have been other things they are going to write him up now on! WHAT! They call to ask me to bring him another shirt because of static but IF there were other important issues they can't call and tell me?Question???? Do you know how long they have to do a write up?Also, I am worried because he is a transfer to this small school and I think they can revoke him for no reason at all!;(Thanks for all input! Add a new provision when there is a determination that the behavior was a manifestation of the disability.If the LEA, the parent, and relevant members of the IEP Team make the determination that the conduct was a manifestation of the child’s disability, the IEP Team must either conduct a functional behavioral assessment, unless the LEA had conducted a functional behavioral assessment before the behavior that resulted in the change of placement occurred, and implement a behavioral intervention plan for the child or, if a behavioral intervention plan already has been developed, review the behavioral intervention plan, and modify it, as necessary, to address the behavior; and except as provided in 34 CFR 300.530(g), return the child to the placement from which the child was removed, unless the parent and the LEA agree to a change of placement as part of the modification of the behavioral intervention plan.[34 CFR 300.530(f)] [20 U.S.C. 1415(k)(1)(F)] I hope this helps. They can revoke the transfer based on academic grades, attendance or behavior but the catch is if he has an IEP almost all behavior can be explained by his disability. Therefore they couldnt actually kick him out of that school for those reasons. But they will try and it will be a constant battle for you. My heart goes out to you. In there it should clearly define the districts definition of suspension and what constitutes a suspension. We had this issue this year with suspensions. My son was suspended five times in three months of school and once we were even threatened with juvenille authorities if we didn't pick up our son because he was refusing to do work. One time he was suspended because he had been sent to the office three days in a row!! We finallly had to get an advocate and we wrote a letter to the direcotr of special education dept as well as called the state DOE special ed dept. Unfortunately some (many) schools will push and push just to see how far they can go. It is dispicable. I am SO glad you got an advocate and that they didn't cut the school any slack. They don't deserve any slack! We had to have the criteria specically described in my son's BIP this time so they will never get away with what they put us through again. You should do this as well. Make sure in your son's BIP that the criteria for suspension is very specifically described. Also on his IEP under the category "social/emotional" have them put a goal that he will use appropriate methods to express his feelings and manage frustration, then they will be responsible as well for TEACHING him these things. <<hugs>> again to you both!ne Wow, that is insane!!
